Potential CCJ - confused and scared

Potential CCJ - confused and scared 11th Aug 18 at 3:47 AM
Hi everyone. Needing some none judgemental advice as I feel awful.

I'm 21 years old and last year I took out a £400 loan with MyJar. I can't remember what the monthly repayments were.

I stopped paying this loan in August 2017, the loan was taken out in May 2017. I stopped paying because I lost my job due to severe health issues landing me on benefits. I wrote an email to MyJar discussing this and they agreed to reduce my payments and also freeze interest. I didn't think I needed to reply to this email as I felt it was confirmed with them that this would be the payment plan so I went on with my life, in and out of hospital and such.

In December 2017 I started getting emails from a company called Secure Recoveries. In short, they told me they'd taken my MyJar loan on and it had spiralled up to £900 that I owed them. I set up a payment plan but again due to my failing health (I very nearly died) I stopped paying this and had no further updates so I stupidly forgot about it. Yes I'm an idiot and yes I am ashamed.

Last night (It is now Saturday morning at nearly 4am, I've been up all night worrying) I decided to check my credit file. My credit score is moderate, not great but not terrible and one section said I had overdue debts. I clicked on it and of course MyJar pops up. I automatically sh*t myself as I remembered I'd forgotten about it. I went on my emails (Which I never go on) and searched for Secure Recoveries and saw they last emailed me in June asking me to set a payment plan up, June of this year (2018) that is. Of course at the time I didn't reply to this email.
They had sent me a link with login details within this email telling me I could start a repayment plan online. I followed the instructions and my login was declined repeatedly so I can only assume they've sold my debt on again or it's about to go to a CCJ.

I know nothing about CCJs but it seems that would be MyJars next step. I'm currently living away for University and when I last visited home I hadn't had any letters from any debt collection companies however my Dad is pretty loose handed and tends to accidentally throw things away (My mum is always complaining about him throwing letters away without knowing what they are) so I've no idea if MyJar have already put a CCJ against me and I've just not had chance to respond or open the letter
I don't know how these things work but I'm shaking and cannot sleep because I have visions of Bailiffs going over to my parents house whilst I'm at Uni because I didn't see/open a letter that had info about a potential CCJ. MyJars collection company, Secure Recoveries last attempted to speak to me in June and I've had nothing since (As I stated above)

I've checked my credit file tonight and no CCJs are listed against my name, does this mean it's unlikely Bailiffs would be round any time soon? I FULLY intend to contact MyJar/Secure Recoveries ASAP but their helpline is closed over the weekend.

I'm so worried. Someone please advise me here as I can't stop shaking/wanting to vomit. My parents would actually disown me...

    Hello,

I'm only passing on information that others have sent to me... it seems you're concerned about whether you have a CCJ or not. Although your credit file says no, you could go onto Trust Online webite and pay a small fee which safely checks whether you have any CCJ's in your name.

Regarding the bailiffs, if you intend to set-up a new repayment plan they won't be visiting.

    Take care!

sorry to hear about your predicament

CCJ is a County Court Judgement.
have you received any paperwork for any court hearing? it would be a County Court Claim form.
have you missed a court hearing?
the company cannot simply put a CCJ in place, they will need to apply to court for a hearing, and if ruled in their favour, then yes, a CCJ could be granted

so speak to whoever holds your debt now, and make an affordable arrangement to repay what is owed.

IMHO, there is no need to pay a fee to see if you have a CCJ.

    see green below...

Did you maintain or default on the arrangement? if maintained, you can get back to myjar and request debt called back to them as arrangement not broken and you did what was asked of you

I've checked my credit file tonight and no CCJs are listed against my name, does this mean it's unlikely Bailiffs would be round any time soon? I FULLY intend to contact MyJar/Secure Recoveries ASAP but their helpline is closed over the weekend.

Bailiffs cannot collect this type of debt without a CCJ being in place, so no bailiff action will be taken

    Morning everyone.

As far as Iím aware Iíve had no court papers but as I said above, my dad has potentially chucked out any letters I had, he does this if I donít claim them quick enough as heís pretty absent minded.

This morning I tried to log into secure recoveries again to set a repayment plan up and this time it let me log in and set a repayment plan up of £40 a month. I got an email saying it had been successfully set up and that was that.

Does this mean that MyJar havenít applied for a CCJ against me if their debt recovery company is still allowing me to do business with them? Iím not sure why the website wouldnít work last night

No, it doesn't mean that, but if there is no CCJ on your files and no paperwork received, it's very unlikely you have, or are in the process of getting, a CCJ.

Stop panicking about county court judgements, there is a process to go through, first you would of received a letter before claim, then if it remained unresolved, a claim form, there would then be a hearing, none of this has happened.

The repayment plan is agreed, as long as you stick to the payments, that will be the end of it.
