Terms and Conditions

1. PARTICIPATION:
   1. By entering this Visa UK 2017 “Big Ticket to Benicassim” Android Pay Competition (the “Competition”) you agree to be bound by these terms and conditions (“Terms”).
   2. The Competition is open to legal United Kingdom (UK) and Northern Ireland residents who are aged 18 years or over. Employees and their immediate families (parents, spouse, children, siblings, grandparents and grandchildren) of Visa, and anyone (including the Promoter's agents and suppliers) professionally connected with the Competition are not eligible to enter.
   3. Entrants must be a valid UK Visa cardholder at time of entry. Valid Visa cards include any Visa debit, credit or prepaid card issued in the UK, including Visa corporate or commercial cards. Entrants must be individuals, not corporate entities, and entrants using Visa corporate or commercial cards must obtain their employer's permission before entering into this Competition. Entrants are responsible for any tax liabilities that arise in respect of their participation in this Competition and the receipt of any Prize under this Competition.
   4. No purchase is necessary for residents of Northern Ireland (see paragraphs 21-23 of these Terms and Conditions).
   5. There will be 1 (one) Draw comprising the Competition (the “Draw”)
      
      The Draw opens at 13:00 (BST) on 8th May 2017 (the ‘Opening Time’) and the closing time for receipt of entries is at 23:59pm (BST) on 5th June 2017 (the ‘Closing Time’).
      
      For the purposes of this Competition, the period between the Opening Time and the Closing Time for the Draw shall be referred to as the “Promotional Period”.
   6. The Promoter reserves the right to seek verification of eligibility to enter and receive a Prize under these Terms. If, in the Promoter’s reasonable opinion, a Winner is found to be ineligible, the Promoter reserves the right to disqualify such Winner and award their Prize to another entrant (in accordance with the procedure outlined at clauses11 – 16), and to require the return of any Prize already awarded, at its sole discretion.
2. ENTRY:
   1. To enter the Promotion, entrants must make a valid Visa payment using Android Pay during the Promotional Period and complete the entry method detailed below in Clause ten (10).
   2. A valid Visa payment using Android Pay must be made for each entry and each may only be used once in respect of entry to this Promotion, irrespective of the mechanism of entry: Facebook. (“Entry Type”).
   3. Each Entrant may only enter the Promotion up to a maximum of 5 times within the Promotional Period irrespective of Entry Type.
   4. All entries must be made by the person entering the Promotion. Anyone trying to circumvent this rule by using alternative details will be disqualified from this Promotion. Bulk entries made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’ or any other automated means, that person’s entries will be disqualified and any Prize award will be void. Syndicated entries or those made using methods such as a computer macro, script or the use of automated devices or processes are not allowed and all such entries will be disqualified and any Prize won will be null and void. In the event that the Promotion is subject to any form of multiple entry activity or other abuse, either as described above or by way of other mechanisms, the Promoter reserves the right to include additional fields on the entry page of the Promotion’s website. Such added fields will only require entrants to provide verification information that they are obliged to retain under these Terms & Conditions to claim any Prize.
   5. There is one (1) way of entering this Promotion after making a valid Visa payment with Android Pay as follows:
      1. Entry via Facebook Visa UK (“Facebook Entry”)
      (i) Entry via Facebook
      After making a valid Visa payment with Android Pay during the Promotional Period, the entrant can do the following:
      
      • Log in to their Facebook account or sign up for free at https://www.facebook.com (if they do not already have an account); and
      • Abide by Facebook Terms of Service (which can be found at: https://www.facebook.com/legal/terms) and
      • Like OR Comment on one of the relevant “Visa UK Big Ticket to Benicassim” posts.
3. COMPETITION AND WINNER NOTIFICATION:
   1. Upon expiry of the Promotional Period for the relevant individual Draw:
      • One (1) Winner will be selected at random from all eligible entries on Facebook. Incomplete entries and entries which do not satisfy the requirements of these Terms will be disqualified and will not be counted.
   2. The Winner will be notified (”Notification”) by Visa UK that they have won within 48 hours of them being selected in accordance with clause 11 above and asked to provide their email address to which all future correspondence about the Prize is to be delivered. Entrants who have not won will not receive notification that they have not won.
   3. The Winner’s response to the message claiming their Prize must be received within 5 days of the date of Notification. The Notification shall be deemed to be received by the Winner on the date and at the time that it has been sent by the Promoter. The Winner must provide names of the two (2) people to accept the trip.
   4. The winner will be required to share a photo or scan of their valid Visa Android Pay payment or provide proof of relevant Android payment on their bank statement.
   5. If any Winner:
      1. is not able, for any reason, to accept a Prize; or
      2. cannot be contacted at the end of the 5 day Notification period; or
      3. does not respond to the Promoter’s request for confirmation of that Winner’s postal address within 5 days of the winner confirming acceptance of the Prize; or
      4. does not respond to the Promoter’s request to complete the form giving evidence of the Visa payment with Android Pay within 5 days of the winner confirming acceptance of the Prize; or
      5. does not provide a complete form where the evidence of a Visa payment with Android Pay can be substantiated in accordance with these Terms and Conditions within 5 days of the winner confirming acceptance of the Prize
      Then the Promoter reserves the right to award the Prize to another entrant (selected in the same way and at the same time as the original Winner).
   6. In the event that the Promoter decides (in accordance with these Terms) that the Prize will be awarded to substitute Winner(s), such substitute Winner(s) will receive a Notification in accordance with clause 10. The substitute Winner must complete the claim within 48 hours of receiving Notification.
4. PRIZE
   1. 
      The Winner will receive one (1) trip for two (2) people to Festival Internacional de Benicassim as part of the “Benicassim Big Ticket” package. The “Benicassim Big Ticket” package includes
      • 4 nights’ glamping accommodation, based on two people sharing with bed, duvet, breakfast service and access to VIP bathroom facilities (13th-17th July 2017)
      • 2 x return flights from London arriving 13th July and departing 17th July 2017
      • 2 x VIP Festival Internacional de Benicassim Tickets (13th July – 16th July 2017)
      • Visa prepaid wearable & Visa merchandise
      • Visa “Best Seats” access
      • Ground transportation
      Prize excludes local transfers in the UK to and from departure airport and anything else not mentioned within the “Benicassim Big Ticket” package.
   2. This prize is valid for two people travelling together, and both members of the party must be aged 18 or over.
   3. The Prize is as described above and no cash or alternative Prize is available. The Prize is non-transferrable and non-refundable.
5. NORTHERN IRELAND RESIDENTS ONLY: NO PURCHASE NECESSARY ENTRY ROUTE
   1. Residents of Northern Ireland may enter the Promotion without making a purchase, although they are required to be the holder of a Visa Card.
   2. Northern Ireland residents may only enter 5 times per person per day in total, irrespective of the Entry Type.
   3. All entries from Northern Ireland residents must be received within the Promotional Period.
6. LIMITATIONS OF LIABILITY:
   1. So far as is permitted by law, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from:
      1. any postponement or cancellation of the Competition;
      2. any changes to, supply of (including, without limitation, the Prize which does not reach the intended recipient), cancellation of or use of the Prize; and/or
      3. any act or default of any third party supplier;
      4. any act or default by a Winner or their guest (including, without limitation, not providing Visa with the travel information in the required time frames, unacceptable travel documents (including, but not limited to passports and travel visas) missed flights and transfers, resulting in the Winner or their guest being unable to activate the prize and/ or any elements of it) which are beyond the Promoter’s reasonable control, including (without limitation) communications failure with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this Competition, inaccessibility, unavailability or any kind of failure of the internet, any relevant website, mobile phone network, any software, any hardware or any combination thereof.
   2. The Promoter will not be held liable to any participant for any fraud committed by any third party, the performance of any contractual or other obligations of any third parties associated with the Prize nor for any events beyond its control.
   3. The Promoter accepts no responsibility for entries not received, not delivered, incomplete, indecipherable, or not in accordance with the entry instructions. No responsibility will be accepted for any entries that are delayed or that are unable to be sent due to lack of network coverage, operator error, or for any other reasons beyond its control. Promoter must receive an entry for it to be valid – proof of sending entries will not constitute deemed entry.
   4. Nothing in these Terms in any way limit the Promoter (or any other person or organisation’s) liability for (i) fraud, or (ii) death or personal injury caused by its own negligence.
7. GENERAL
   1. The Promoter's decision is final and binding in all matters relating to the Competition.
   2. The Promoter reserves (in its sole discretion and so far as is legally permissible) the right to verify, using all reasonable means available to it, whether an entrant is eligible and/or whether a winning entry is valid. If there is any reason to believe that there has been a breach of these Terms or of the spirit of the Competition, the Promoter may, at its sole discretion, refuse to accept an entry and, if necessary, re-allocate any Prize won in accordance with the procedure outlined at clauses 10 - 14.
   3. Participants hereby represent and warrant that each Entry they submit to the Competition complies with these Terms and Conditions, and: (a) is their original work; (b) has not previously been submitted in any competition or other promotion and has not won an award or prize of any kind; (c) does not contain any use of the names, likenesses, photographs, or other identifying elements, in whole or in part, of any person, living, or dead without permission (proof of which must be provided to Visa upon request); (d) does not include trade marks, logos, or copyright protected material which belongs to third parties without permission from the owner (including, but not limited to, company names, music, photographs, motion picture or television programme clips or audio tracks, works of art, or images published on or in websites, television, movies, or other media); (e) is not subject to any third party agreements, and the Promotor will not be required to pay or incur any sums to any person or entity as a result of its use (as set out in these Terms and Conditions) or the exploitation of the idea or video or rights therein; (f) does not defame, misrepresent, or contain disparaging remarks or any other content which could adversely affect the name, reputation or goodwill of the Promotor or any other individuals and/or entities, the determination of which shall remain in the sole discretion of Visa; (g) does not contain pornographic or sexual content, hateful or content of any kind (including racism, sexism, etc.), content which promotes violence or harm to another living creature or any other offensive, obscene or inappropriate content, the determination of which shall remain in the sole discretion of the Promotor; (h) does not include threats of any kind or that intimidate, harass, or bully anyone, or invade the privacy of any person, the determination of which shall remain in the sole discretion of the Promotor; (i) does not violate any applicable local state, provincial, national or international law or include any content that would encourage or provide instructions for a criminal offence; (j) does not feature, refer to, or mention any brands competing with the Promotor; (k) does not contain any known virus, trojan horse, worm, trapdoor or similar software that may in any way infect or affect any of the Promotor’s hardware or software systems; and (l) complies with any content guidelines made available by the Promotor in relation to the Competition.
   4. The Winner, by accepting his/her Prize, consent to the Promoter (in its sole discretion) publishing his/her name, county, photograph and any statements made by or attributed to him/her in relation to the Prize or Competition on the www.visa.co.uk/goldenspace website and in any print, Twitter @VisaUK, Visa Facebook page, point of sale or other public relations materials related to the Competition for advertising and publicity purposes, without additional remuneration. The Promoter may require the Competition Winner to provide this consent in writing to the Promoter prior to receiving their Prize.
   5. Participants will retain copyright in their Entries but by entering the Competition hereby grant the Promotor and its agents an irrevocable, worldwide, royalty-free, perpetual license to edit, alter, store, publish, sub-license and use each Entry, or any part(s) thereof, in any media (including without limitation on the Website, on www.visa.co.uk, in media belonging to third parties or otherwise) for promotional, publicity and commercial purposes and/or to exploit or adapt any of the ideas contained within it, regardless of whether or not the Entry wins a prize (although nothing in these Terms and Conditions or otherwise obliges Visa to use such materials in any way), in each case without any obligation on Visa (or other entity) to give any payment or acknowledgement to the participant. This licence is granted on an exclusive basis: by entering, the participant confirms they have not granted any rights in any element(s) of their Entry to any third party and will not do so, other than as necessary under Facebook's standard terms. Participants also hereby irrevocably and unconditionally waive any and all moral and similar rights vesting in their Entries and undertake to execute all such documents as are reasonably required by Visa to perfect or confirm the rights granted in these Terms and Conditions.
   6. The name and County of the Winner may be obtained by sending a self-addressed stamped envelope by 31st July 2017 to Visa UK Benicassim Big Ticket Promotion, Bright Blue Day, Parkway House, 26 Avenue Road, Bournemouth, BH2 5SL
   7. The Promoter reserves the right to terminate or temporarily suspend this Competition in the event of technical or other difficulties that might compromise its integrity but will always endeavour to minimise the effect on participants.
   8. In administering this Competition, the Promoter may collect personal information from entrants. The Promoter will comply with its obligations under the Data Protection Act 1998 and other applicable data privacy laws and it will only use entrants' information for the purposes of the administration of this Competition and in accordance with Visa Europe's Privacy Policy and any preferences expressed by entrants during the Competition entry process.    9. In the event of unforeseen circumstances outside its reasonable control, and where circumstances make this unavoidable, the Promoter reserves the right to modify these Terms prior to the closing date.
   10. Subject to clause 21, Facebook is not liable for anything arising out of this Competition and shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the Competition or acceptance of a Prize.
       The Maraworld, S.A., the organisers of the Festival Internacional de Benicassim, Visa Europe Services LLC (other than in respect of any liability for negligence causing death or personal injury) are not liable for anything arising out of this Competition and shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the Competition or acceptance of the Prize.
   11. This Competition, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Competition.
