bankrupt ??

hiya,

Well this is interesting, i was made bankrupt last year oh about Nov 2016, I seem to be the one who slipped thru the net, I do not have an OR looking after me, althou i did contact them after i got the court order and was told we will contact you, when we get the order, well that was 4 months ago, she did log that i had rang.
So far i have sent my copy of the court order to my creditors, in efffect doing the ORs job for them.
Firstly am i doing the right thing ? i def dont want to do anything illegal ? but i dont find it fair that my creditors should suffer due to unforeseen circumstances.

any suggestions, cos im not on the insolvency register nor on my credit score, so as far as anyone is concerned im not bankcrupt

    It is an unusual situation but not unheard of. Sending your creditors copies of your BR is fine - you wont get into trouble and its quite common for people to do that to stop the chasing and the creditor wasting money pursuing the debt via the courts.. They need to contact the OR - there is nothing for you to do now. Is your income likely to warrant an IPA? If not, you may just be at the bottom of a very full in tray in terms of priority.
    Sit tight and wait - they will get to you eventually.
  • Do not rock the boat. As long as you co-operate fully when asked, if not lay low for 12 months until discharge.

    Besides being approved to go bankrupt and also having the bankruptcy order to hand for your creditors, I take it that the Insolvency Service themselves have not even made contact in regards to the long telephone interview that they have to conduct with yourself?

    It does seem odd that after it being a while since you were made bankrupt that you've heard very little from them. Saying that, I do get the impression from them that they have undergone a lot of staff changes / increase in work as of late. I made myself BR back in July of last year and I was assigned my own individual advisor straight away and dealt with her on a few occasions within a space of the first 5 or so weeks to get it all in order. However when I changed address in November I attempted to contact her personal line to notify her of the change of the address and I couldn't get through, I instead rang the main office and then found out that she was no longer with them and someone else had been assigned to me instead.

    Apparently since the Insolvency Service changed the way of applying for bankruptcy to online / everything being dealt in their offices and no longer making appearances in court a few months ago their work load has shot through the roof which doesn't surprise me. As also mentioned, wait for them contact you - as they will eventually. Also as long as you supply the bankruptcy order to all of your creditors, they can no longer persue you for the debt and continual communication / harassment to yourself will be breaking the law.

    How is it that some people stay off the register?

    I know of someone who disputed their bankruptcy (brought by a creditor), then lost at week 51 and were discharged in week 52, they are not on the register.

    My concern is that some years ago I borrowed money from some very dangerous people, the sort that do not absolve debt. I had to leave the country to get away from them and settled back in a completely new town.

    If they see me on the register they will know I have come back, same applies if I name them as a creditor.

    Is there a way I can stay off the register?

    Something along the lines of this is a procedure that can be applied for during bankruptcy which applies to those who could pose a risk to violence if they are exposed as being bankrupt. Basically what this procedure does is that the Insolvency Service specifically instruct The London Gazette / Credit Reference Agencies to not list the individual as bankrupt, as in the event that they are exposed - danger could come their way if they are in debt with the wrong type of people.
