Oh yes, you can add most any date instead of 2007 and get results. THIS is what they TRY to hide from you, that your MORTGAGE HAS ALREADY BEEN SETTLED and that there has been FAILURE of full disclosure under UK contract requirements as you were NEVER made aware that you were to be a party to a third party investment. Indeed it appears that GMAC's businesws model was to issue mortgages as fast as they could with the sole intention of securitising them thus making a very fast buck. If your Note has been sold on (and you can bet your life it HAS) then you are paying TWICE for your mortgage. :mad:

Check your deeds and your insurance documents to see if there are any "unusual" companies which are declared as having an interest in any mortgage you might have or have had with GMAC RFC or PARATUS AMC.

Bear in mind that accordingly, if the mortgage has been securitised, then this should show on their "off balance sheet accounting" HOWEVER, by their own admission it seems they may not follow GAAP. This would allow them to hide the TRUE holder of WHO owes whom, what, but you can be 99% sure YOU, as an alleged mortgage holder do NOT in reality OWE ANYTHING.

Ask your current "mortgage holder" or more appropriately "mortgage service Company" to produce the UNMARKED / UN-ENDORSED BORROWERS NOTE, they will NOT be able to because it has been SOLD ON and YOUR debt EXPUNGED!! :j

If they DO produce such a Note then I can assure you it is either a fake OR they have held the original documents with the sole intention of being able to produce them should you make such a request. this is CONSPIRACY TO DEFRAUD. Indeed I have seen PROOF of at least one company issuing a "securitisation prospectus" which offers to commit this fraud on behalf of the buyers of the SPV. :eek:

Subpoenaing these accounts, both OFF and ON Balance Sheets, their liabilities and receivables side should show that the transaction has been done and thus provide the required evidence to allow you to argue a good case in court, BUT....I'm sure they will doctor the books to show otherwise. REMEMBER there will ALWAYS be a papertrail and finding an entry point to it is key.

This matter requires a LOT of further investigation but there are numerous failings under section 123 of the LRA2002 as to who the true "owner" of these "mortgages" is. There may also be questions involving Tax Evasion though who by and how is not yet known.

Your "Note" is an UNREGISTERED security and it shouldn't be, as a security cannot, as far as I am aware, have T&C attached.
Most of these trace to a link with a PLC called Law Debenture which trades your "mortgage" Notes under a "made for purpose" vehicle. They claim NOT to engage in FCA regulated activities yet you can buy shares in their company based on the activities and portfolio of the made for purpose companies which they in turn hold an interest in.

MORE research needed here but if you have a mortgage with ANY company involved in this circle (Yup HSBC and Barclays are in there too) then it might be a good starting points for you is you are facing any action by any of them.
