News from Within MBNA ......

..... Keep your claims going, they have no intentions of defending any action as they cant justify the charges.

Appreciate this may be realised by most, but this is FACT from within the walls of said company.

Trust me.

  • this would apply to ANY credit card currently issed by MBNA - these are A&L, Virgin, Abbey and whole host of "backed cards" - eg most (if not all) football club cards are issued by MBNA - other sporting events, some music related cards - Sony cards (previously HBOS).

People need to look at their Statements I would suggest to see who the card is issued by, or where the registered address is. MBNA is on Chester Business Park, though most people with their cards would already know this.

Would they be able to insist that outstanding balances are repaid? This is what is holding me back from claiming from these people because I have not been able to find a way of transferring my balance elsewhere.

I made a calim against MBNA for £111.00. They disputed the claim but credited £40 back to my card as a gesture of goodwill. When I told them I was continuing with my claim they credited the other £70 without argument.

I issued 9 County Court summonses last week to various credit card companies. American Express telephoned immediately to settle. The only thing they disputed was the fact I was claiming contractual interest and the claim amounted to £904.00.

They offered to refund all charges + interest at the standard 8% + court costs and said they would credit £752 against my card which has an outstanding balance of about £2000.

I responded by saying that I already had a DMP in progress to repay my card and would accept their lower figure if they sent me a cheque, otherwise I wanted the full £904 credited to the card. They agreed to send a cheque.

I think they can yes, I am in the same boat as you, I'm waiting for MBNA to pass to Debt Collector before I challenge them.
It's actually starting to annoy me the amount of time it's taking....

  • I believe the situation is the same with all companies.

If your account is at zero, or is closed you can request a cheque

if your account has been passed to a debt collector, the amount will be forwarded to them (have already seen this)

If you are in a DMP/IVA then they have to send you a cheque, the reason being they have already agreed to accept a lowered figure, and by paying off their own debt using this money means they are claiming priority - and legally they cant do this.
