Rundles Bailiffs... coming tomorrow....

I got home this evening to find a letter through the door from the debt collectors, saying the are coming back within 2 days with the police if necessary, to remove my goods for the debt owed.

I was paying the debt off to them every month for over a year but have had a lot on my mind and completely forgot I hadn't been paying it, I have missed 2 payments.

I have logged onto the website and it now says I have 2 debts with them, the original one (for £350) and a new one of £550.

We have had no other letters from them about this new one. We have also had no letters about missed payments.

Can they come into the house forcefully?

Do they have to get a court order and would we receive anything to say this had been done?

No one has been into the house and I have not signed anything with them.

I am going to ring the council first thing to see what's going on, and have also left a message with the bailiffs asking them to ring me back... what can and can't they do in this situation??

Am so glad websites and forums like this exist sorry its late....

    The law states

    The bailiff can call at your house at any reasonable time to seize goods, but you do not have to let them in.

    The bailiff cannot enter your house by force.

    They can legally enter your property through open windows or unlocked doors, so make sure all your doors and windows are locked or closed!



    Reality

    If baliff turns up tomorrow tell them to go away, and say it as rudely and loudly as you want.

    If you refuse to open your door and let them in, then they are powerless to do anything. :D


    And the fact they may even have a police office with them is totally irrleveant as you DO NOT have to let the police officer in either.

    Although the police officer WILL NOT want to enter you home anyways.
    They are only there to make sure that you dont attack the baliff, but NOT to assist the baliff in entering yoru home.

    Im no expert but I was under the impression that bailiffs can only force entry if they have previously gained peaceful entry.

    Correct :) Even if they make excuses, want to use the toilet, need to make a phone call etc. DO NOT LET THEM IN!

    Also, if you have a car parked on your drive, move it away from the house as they can levy on it if it's on your property.

    it depends on what the debt is for--- what you have quoted is for civil debt, i suggest you go look up what happens if its a non payment of a magistrates court fine

    TO OP
    what is the debt for, if it is civil debt then they cannot enter house by force, they can however try all doors, climb thru windows etc.

    IF YOUR DEBT IS A MAGISTRATES COURT FINE/ SPEEDING ETC
    then under paragraph3 of schedule 4A of the magistrates court act and also the DVCV act- both 2004 then forced entry can be used.
