Question about claiming back bank charges

Hi
I was wondering what the position is with claiming back bank charges if you owe the bank money through overdrafts / credit cards. I have yet to do the calculations but have a feeling that the Yorkshire Bank could owe me a fair bit.
However, as I still have a £500 overdraft with them and owe £10k on a YB visa card, I really don't want to start something with claiming bank charges back, only for them to say that they are closing my accounts and want £10.5k from me immediately!
Does anyone know?

hi Flowes from my experience and reading previous posts most people are claiming back charges from their current accounts and cards, im with the cccs and i wont be claiming back charges incurred with my debtors as i dont want to rock the boat but i have just wrote to my current bank and asked for £180 back from charges over the last 2 months! you could write to them and say you are claiming it all back and wish to knock it off some of the balence you owe?

Yes it is my current account I am looking at, but as I said, I really don't want them to start causing further problems, like wanting to close my accounts because they don't want me as a customer?0 -
well you have to decide whether you need the charges back you can go as far back as 6 yrs but the way its going banks are catching on and you might not have the chance in 6 yrs time to claim it back if you see what i mean there are other banks and if they close the account you can still claim back the charges and as far as your outstanding debt unless you default i dont think they can demand it back in full

I'm literally just starting to claim my charges back too. I am with CCCS and they did say though that I'm fine to do so. The bank I'm claiming back from (HSBC) have made no efforts to recognise the situation I'm in and the fairness of the offer I'm making through CCCS. So, claiming my bank charges back will only reduce the debt I have with them as the £1000 I intend to get back I will merely use to pay off HSBC (unless they carry on charging interest in which case I'll pay off MBNA!)!0

haha the HSBC are !!!!!!s! in a word they will continue to charge and take paymentetc as long as they can they will passs it over eventually now i owe them heeps and they are the ones im not pushing as i really do owe them loads however if they push me in to a corner i will chase but saying that i have been advised by a rather nice lady from the hsbc yes nice and no not a call centre!
" we will have a meeting when your account defaults by 4 payments we tot up the outstanding and claim for it in full however we will refund any charges incured to you when gettinga final figure" ( well they didnt do this on my credit card and im hoping i wil claim back from them in a few more years i have several 1000's to claim back in charges from them they have handed over 2 of my 4 debts to metro collections now they freexe interest no more charges are incured and they accept payment proposal

Just wanted to check, they keep on taking my full loan amounts from my current account taking it over the overdraft limit and I've been told by CCCS to ignore it, let it carry on and default so it goes to Metropolitan...any idea how long it takes (I realise you said 4 defaults but is that a default a month?)
Is there any way I could pay off the over draft in full (when next CCCS payment goes in will be around £300) and cancel my current account to speed things up a bit?0 -

hi babes, well they wont let you close the account as the loan has to be taken from somewhere if you pay of fyuor overdraft they will take another payment prolonging it i would pay what you usually pay then when they can not take anymore they will default you how mant have you missed?
or are under the official payments?
what usually happens is cccs role the two debts into one so although your loan is coming down your overdraft is rising but the payment can not be made to the loan account only the bank account

Well they've had no full payment since April 06 except...when they just took the full amount last month then taking it over the overdraft.I've had 3 missed payments I think but then one going in. Does the payment they took in full (even thought the money wasn't there in my overdraft) cancel teh others out? I sincerely hope not! I want to be defaulted!0 -

No hun it wont cancel the others out the lady i spoke told told me if you have accumilated 4 missed full payments in total it will be handed over but they have to find a final sum first this should be judgement month next month for me 25th August im hoping it will be handed over no quibbles etc then i will close the account down i might even consider going for charges then to reduce some from my other debts but thats a big might!:eek:
try not to worry have they contacted you regularly to advise you are not paying enough etc by phone or letter im assuming they havent accepted your payments as exceptable?

They've contacted me tons regarding the amount and I keep on saying that I'm paying all I can. Also they've sent numerous applicatoin packs for their dreaded managed loans, all of which have been kept, but ignored!!
