Hi,
Just wondering whether anyone can help me on a absence issue.
My girlfriend was off for a month with stress. Her contract states that if she is off for more than five days she does not receive sick pay. Would this be under all circumstances or can she argue her case?

If its written in the contract then yes its right and wont be worth arguing! She should be able to claim SSP.What you can claim if you're not eligible for sick pay
If you aren't entitled to anything under your company scheme, your employer should still pay you SSP if you're eligible. You won't be eligible if:
you've already had SSP for 28 weeks
you were receiving incapacity benefit within the past eight weeks
you're receiving maternity allowance or statutory maternity, paternity or adoption pay
If you're ineligible for SSP, ask your employer for form SSP1. You should send this straight away, along with a doctor's certificate, to your local social security office to help you claim incapacity benefit
