Customer perspective - employing someone with a DRO

    Personally, I would suggest him writing a materials list and you collecting them from the merchants. Either that or going along to the suppliers with him. Your guy may well have the best intentions, but what is the point in exposing yourself to risk? Just say you need to use your credit card to pay.

    He may not like the idea though as obviously he will have a negotiated discount with his favoured suppliers which he will use to make his mark up % on the required materials.

    Most tradesmen/women use a small discount from their supplier as a way to help keep quotes competitive - but that's not really what you are asking is it...

    If I thought you didn't trust me as a supplier - yes, I would refuse. No business relationship can be successfully based on suspicion and where one party sets out being clear they do not trust the other. What do you think this guy will do that another wouldn't - what's the fear? that he'll run off with your cash?

    You don't know why the guy has a DRO - maybe another customer ripped him off? At least with a DRO he is taking responsible action to remedy the problem and settle with his creditors.

    This board is really a support forum for those in need of support at a difficult (sometimes very traumatic) time - its not really for postulating on who you want to do business with. :)
  • If you want to employ the guy - go ahead - state your terms (buying the materials yourself)and get on with it. Its a simple position to take as others have pointed out.
    Forgive me if I seem sceptical - this decision does not need a discussion on a support forum - it simply needs you to offer your terms and for him to accept - or not. However, I don't believe its worth trading with someone you don't trust and if the DRO or his failure to mention it to you is an issue - then I guess there is something other than altruism that makes this particular supplier worth all the soul searching?
    I am sure there are plenty of other suppliers out there you can hire for the job without the same issues - but avoid the Alan Sugar or Richard Branson types :)

    Anyone who takes responsible action to deal with debt deserves a little credit maybe?

    There is no requirement to declare a debt relief order to anyone, except under these circumstances :

    46.92 Restrictions on a debtor subject to a DRO

    (Amended March 2013)

    Where a debtor is subject to a DRO, during the moratorium period [note 22] (see paragraph 46.74) it is an offence for that debtor to:

    Obtain credit in excess of £500 without telling the person from whom he/she obtains the credit about the DRO [note 23] [note 24].

    Engage directly or indirectly in any business under a name other than that in which the DRO was made without disclosing to all persons with whom he enters into any business transaction the name in which that order was made [note 25].

    Act as a director of a company or directly or indirectly take part in or be concerned in the promotion, formation or management of a company, without the leave of the court [note 26] [note 27].

    These restrictions imposed by insolvency legislation carry on for the period that a debtor is subject to a DRRO/DRRU (see paragraph 46.94) [note 28] [note 29]. Further guidance on restrictions imposed on debtors subject to a DRO, DRRO, IDRRO or DRRU can be found at Chapter 46, Part 7.

    Under the restrictions imposed by his DRO he is not supposed to have more than £50 per month excess income.

    "Debt Relief Orders for Self-Employed People

    If you are self-employed and apply for a debt relief order you will not be allowed to act as a Company Director without specific Court permission. In addition, there will be many restrictions placed on carrying on business as a Sole Trader or Partnership. If you are self-employed, it is essential that you take specific advice before applying for a debt relief order."

  • I'm finding this thread rather bizarre and I'm surprised it's had so many posts, if you want to use this guy just tell him you are buying the materials yourself because that's want you want to do, why have to give him a reason or delve into his past...it's a completely sensible way of doing it anyway, DRO or not!!!
