Geoffrey Parker Bourne, BWC, and EDF energy

I'll try to keep this as brief as possible.

A couple of months ago BCW started ringing me telling me I owed EDF £564. Now, I'm pretty sure I don't owe EDF anything as they have never been my suppliers. I sent them the stop calling letter so they did, and then went through there full repitoire of letters, threatening a visit from one of their monkeys etc.

I then sent them the prove it letter. i recieved one back saying they had informed EDF and they would send me the documentation etc (I'd be interested to see what this would be, as I have never had them as a supplier). It went quiet for a month or so, and then this morning I recieved a letter from Geoffrey Parker Bourne soliciters saying that they were informing me of impending legal action. The letter also says i shouldn't yet enter into correspondance with them, but to continue to speak with BCW.

I'm not sure what to do now. They haven't proved the debt is mine, so surely it is illegal for them to have their soliciters write to me. The legal chill is a bit worrying.

Any advice on what to do next would be much appreciated.

    Presumably you have told them that EDF have never been your suppliers? What is their response to that rather basic point?!
  • there never really has been a response to that point. i sent the prove it letter, they said they would refer it to EDF and they would send me the details, which they haven't, and now they are threatening legal action.

    Would a complaint to trading standards be in order, as well as sending the prove it letter again?

    Send a letter to the solicitors (even though they don't want any correspondence) stating that the debt is in dispute as you have never been a customer of EDF.

    Write an official complaint to EDF stating that you have never used their services and even after requesting information about the alleged debt, this has been ignored. For reference, this debt is officially in dispute.

    You require them to write within 14 days stating that no debt is owed or to enclose proof of the debt. Failure to respond within 14 days will result in complaints to the relevant enforcement authorities including, but not limited to, the OFT, Trading Standards and Ofgem.

    Send both letters by recorded delivery so you have proof of receipt.

    I would advise you don't contact Geoffrey Parker Bourne, The letter is (If i'm correct) a Notice of Pending Legal Action (It will say so on the letter) in which case GPB don't actually have your account details and will only refer you back to BCW (Buchannen Clark and Wells)

    I actually used to work for GPB (for my sins) These letters are sent by BCW with the GPB letterhead to scare you into paying.

    Rest assured that no legal action will be taken on your account until you receive what is called an LBA (letter before Action) from GPB asking you to contact them directly to settle. (Even then they will always try and collect or set up a payment scheme before issuing court papers)

    Continue to follow the usual procedure (asking for copies of signed agreements) Via the post and keep signed copies in case you ever do need to file a defence against a CCJ

    I hope this helped and don't stress about it you are nowhere near legal action at this point.
  • Yup, thats what it is.

    I sent the prove it letter over a month ago and got nothing back, for a while. They (BCW) saying they have contacted EDF and will forward on the details. "Have fun with that" I thought, having not been a customer. I then got the letter from GPB which worried me a tad.

    Not as worried by this now though. thanks
