Holiday entitlment

Hello

I have recently began work with a new employer, working 12 hour shifts on a 3 on 3 off rota.
My contract states that my normal hours of work per week are 42.
It also states in my contract that holiday entitlement for full time employees is 5.6 weeks (28 days) in the complete holiday year. If you work a part time, fixed term or temporary basis then your annual holiday entitlement is pro-rata to the entitlement for full time employees.

So today I have been told, whilst trying to book some of my 28 days holiday, that I actually only have 19.6 days?

Can they do this?

May I also add that for 13 years previous to this job I worked term time so my holidays were to be taken in the holidays, so its all a bit new to me!

  • When does the holiday year start? If it has already begun, you will only be able to take holiday entitlement from when you started.

    As you only work 3 days a week if you had 28 days holiday then that's nearly 9 weeks holidays, ignoring your extra days here and there.

    3on 3off is a 6 week cycle with 21on 21off

    full time over 6 weeks is 30 days

    prorata is 28 * 21/30 = 19.6

    Full timer always need 5 days to make a week(9 day stretch inc weekends)

    You don't need 5 days to book a week off it could be as low as 3 for the 9 days off in a row.

    That's a bit of a strange way of calculating it but you got to the correct answer.

    If you work 3 on 3 off then you will do 70% (21/30) of someone who does 5 on 2 off. If holiday entitlement is earned on the basis of days worked then 70% of 28 is 19.6

    However, since you work 12 hour days half of the time then you will actually work more hours in a year than someone doing 8 or 9 hour days over a 5 day week.

    3 on 3 off us the equivalent of working 3.5 days a week so you get 3.5/5ths of the holiday a full timer gets, so 19.6 is correct.
    On the upside you only need book 3 days off to be off for 9
