Hi my partner is going to apply for bankruptcy in Scotland within the next few weeks, I have a few questions about the process, as far as i remember she would need to open a basic bank account (barclays) now, then contact national debtline, then pay the £200 to the account in bankruptcy , would this be correct, her outgoings outwat her incomings and she has no assetts is it a certainty to be accepted? thanks in advance

  • If she has no assets, she should look at Minimal Asset Process.

The fee for that is £90.

    Hi John paul chris

AdviceSought is right in saying that it's worth checking out the Minimal Asset Process (or MAP) bankruptcy.

If your partner has no assets, owes less than £17,000 and doesn't have enough non-benefit income to pay a contribution then its worth having a word with a money adviser to see if MAP is a possibility.

The link which sourcrates gave you on another thread also has lots of useful info.
