On "cant pay" tonight, a lad owed a couple of grand and outside was a van free of finance, the lads dad had "bought it for him" (the lad), therefore surely making the dad the owner in law (assuming the dads name was on the receipt/invoice) but the sheriffs still took the van....

I can only imagine the sheriffs hear the line 'that's not mine' dozens of times a week. Perhaps calling the debtors bluff and actually having them provide proof is the best solution for a bad situation?
Unless I'm missing something and they have no right to take an item and ask for proof of ownership to prove otherwise?0 -
any ceased assets wont be sold for 14 days (i think) until ownership is proven - sales receipt invoice etc.
was he using "his dads van"? that would be easier to dispute with a receipt, but as it was "bought for him", this tells me it is his property, so doesn't matter who has receipts0 -

As per top of a V5... (and something the sheriffs quote when wanting to take a vehicle in many episodes)..."this is only the V5 and only shows the registered keeper, not who owns it, if you can show the receipt/invoice or funds transfer we cant seize it"
(I had to ask 2 police officers what was stated at the top of the V5 about a V5 not being proof of ownership, 1 knew....1 didnt
Usually only the registered keeper can have insurance0 -
