Hi all,
Just a quick question...
How long until a debt is not allowed to be chased for? i.e. if you haven't had any contact from lender or provided written confirmation you owe a debt?
Any are there any terms that have to be followed (like no contact etc.)?

Hi Tripledrop,
I think you may be referring to the limitations act which applies to simple contracts, more so than anything else.
The limitations act states that if there has been a 6 year block of time, since a debt fell due, with no written acknowledgement or payment (from you to them) and no court action started then the debt is unenforceable in the county court and is known as statute barred.
That isn't to say that you should ignore court papers if they are received and this can be more complicated if more than 1 person is named on the debt. Can you give a bit more context please? What the debt was for and what has been happening that means you are concerned about it?

Thanks guys... I used to be in a debt management plan through PayPlan, and there was a really small debt (less than £200) that was originally an Egg credit card.. This was then purchased by Barclaycard and has since been to Robinson Way and maybe another company.
I stopped payments through PayPlan just over 3 years ago as I made arrangements with all my debtors for settlements.
Last week I received a letter from Barclaycard advising they were passing my debt to Robinson Way again.
I'm struggling to find the proof that I paid it, and they can't find anything, so just wondered whether since I hadn't heard anything for over 3 years, that was an easy out
Doesn't even appear on credit report.0 -
Can I just ask if the bar is five or six years if the debtor is based in Scotland but the lender/creditor is elsewhere in the UK (IE England)?0
