    I would throw the DDA at them personally - they've obviously received your letter as they're refusing your offer, so you can point out that they are deliberately putting you at a disadvantage as they are trying to insist that you phone them. Or, alternatively, write back saying 'yes, I'll phone, I presume you have a video phone and someone fluent in British Sign Language available whenever I call to talk to me?'

    Hi, thanks for that, I didn't think that I could ask for a CCA as I have already acknowledged that the debt belongs to me by offering a F&F Settlement!, (oh god, what have I done?). The DCA are a 'side-kick' of HSBC anyway I think, rather than say 'selling off the debt for a pittance' to some other company - if that makes sense?.

    Hope you get sorted how dare they discriminate against you for being disabled (or anyone else for that matter). For once I'll agree with Stapeley, want the CCA to be invalid and see how they cope with their own failings.

    I am a little upset about your references asking me to phone you as I have already explained that I am deaf. Surely you do not seek to mock my disability or simply seek to try to humiliate me because I am disabled?

    I do of course trust that you only make references to contacting you by phone as you have in fact failed to read my letters which incidently were recieved by your offices on the "insert date" and signed for upon delivery.

    As the letters are in yoru companys possession then I can only assume your reference is for the former and nor latter reason and this does deeply pain me as I am sure you can appreciate having any registered handicap riddiculed is cruel and I believe illegal?

    oh my god are you feeling unwell ! broken hearted ? It does not matter that you have been paying this account . You are still entitled to a copy of any CCA and a notice of assignment . It is seen by some as getting out of paying , but many having been hounded and hassled by these DCA use non supply of a CCA to take control . You can then arrange settlement under your terms .

    p.s. I do not think they are ignoring your request because you are deaf . Its because they are draft.

    Another vote here for bringing the DDA to their attention... by my recolection of the legislation a company must make reasonable effort to provide access to their services for all. I've got a feeling that once you bring the DDA into play and threaten them with the appropriate authority they may suddenly find they can communicate with you only in writing! Basically- everything ZTD said. Let us know how you get on.

    do you have the tele type service? you text an operator, they speak words to the recipient(in this case DCA), and text back what they are saying.. this may remind them that they are dealing with a person with genuine difficulties.. if continue to send stupid letters, may be cause for harrasment?

    failing this, send f/f again by registered post, fax, or email? make it clear that you are deaf, so telephone is not an option.

    Some brilliant wording there, so thanks. Don't have the 'txt type' service at home, and I'm not prepared to use the services at work.

    :eek: You have though bought my attention to the fact that the letter does not even offer the txt type service anyway, so that in itself speaks volumes!!!!. :mad:

    I wonder how the DDA deal with this, this company are so blatently prejudiced against disabled - There is not even a mention of braille either for those with partial sight either.

    One thing though, I don't want to bring the disability law into the equation if at all possible, simply because I don't regard myself with a disability even though I am registered as being so. I think this is because I have a good professional job and nobody treats me differently - apart from the Metropolitan Collection Services AND HSBC !

    Oh and as of the last 1/2 hour so are MBNA!!!!.
    Just to update you, they would only accept Partial Settlement to which I've said "er thanks, but no thanks". Another letter came today from the gorgeous Matt!, (for those that have read the other thread), saying "sorry, no can do"

    Now for the funny bit - "Please contact our Customer Assistance Department to discuss repayment of the outstanding balance"

    Matt IS the Head of Customer Assistance !!!!!!!!!!!!!!!!!!!.

    Words actually fail me at the mo - (but there's no phone number this time)
    So now I have to repeat myself to this idiot (in letter form obviously again) with regards to how I'm going to pay back this debt - which incidently they refused previously - my god I'm rambling sorry.

    just send them this, never sign your letter always print, use a postal order and send recorded delivery

    Request for information under the Consumer Credit Act 1974

    To Whom it may concern,

    Ref Number
    As per sections 77-79 of the above act, I hereby request a True Copy of the Original Executed Agreement for the above account number.

    It is my understanding that:-

    * By law, you must comply with this request within 12 working days of having received it. I am sending this letter recorded Delivery.
    * The statutory fee of £1 is required to be paid for this information, and I have enclosed a £1 Postal Order.
    * In responding to my request to supply a True Copy of the Original Executed Agreement, you must also provide any and all documents referred to in it. Where this may include Terms and Conditions as varied, I hereby specifically request a True Copy of all the inception Terms and Conditions which form the original agreement, and all variations to them since. I support this request with County Court Pre-Action Protocol 4.6 ( c ) .
    * Should you fail to comply with this request in any part, or exceed the prescribed time allowed to respond, you shall be in default of this act and legal request.
    * Whilst you are in default, and until such time as you fully comply, -you may not pursue, enforce or increase any alleged indebtedness, nor disclose any information regarding me to any third party what-so-ever.
    * If you fail to fully comply with this act and request for 12 working days plus one calendar month, you will have committed an offence under the act.

    If you are unable to supply a True Copy of the Original Executed Agreement and all documents therein (and specifically the inception Terms and Conditions), I would be grateful if you would confirm this in your response within the 12 working days allowed.
