Do you think RAS?
I've had a CCCS telephone interview yesterday and they took all of my details, income, expenditure and creditors. He then told me to phone back today with all of hubby's details in the same way - I did this and they told me to phone back on Monday, then they would take the details?
I was really looking forward today to getting some sort of closure be it a debt management plan or bankruptcy, but now I've got to wait another 5 days! My head is exploding! I can't sleep and it's affecting my work, I feel awful.
On taking my details, he said to offer all of my creditors £1 a month as I am £79 short of income (on hold until after 2nd interview) including the statutory demand. He then said, the creditor that served the demand would then probably issue bankruptcy proceedings, there is no assurity that they will be successful but if they are then we do have equity and would most probably loose the house.
So now I'm in a total mess (again!)0 -
Also, should I try and recommence the mortgage payments because he said, as there is already a case in hand for repossesion, it would more than likely be enforced as we have missed another month and I haven't phoned them, because I still don't know what to say??
I thought after today, I would have got that advice but have now got to wait until next week
I can't cope with all of this I really can't!0 -

There is a chance that the creditor who issued a Statutory Demand will petition for your bankruptcy, but it's not that common; they're usually used as a scare tactic.
I don't think the person you spoke to at CCCS could have grasped the situation with the house. Did he/she explain under what circumstances you could lose it? I think we've already established that there's little or no equity.

That is just not true.:mad: :mad: If you feel as though you want to ring the mortgage company then tell them that you're in the process of re-structuring your finances, and you'll get back to them very quickly with a proposal.
Go for a walk, a cry, a rant and a rave, a drink, whatever it takes, but you will get through it.

He said the house is at serious risk because of the repossesion order pending, as we have broken the agreement with the mortgage company to pay them an extra £105 per month, and we've also missed another months payment.
He also said that if the creditor did apply for my bankruptcy, which they probably will because the demand was hand delivered which means they mean business, then we have sufficient equity in the house for the OR to force a sale!
He then finished by saying ,he needs to do it jointly to get an accurate picture, I understand this, but why didn't he just give me another appointment yesterday instead of asking me to phone back today, then give me another appointment in 5 days time?0 -
judging by the comments made by cab on here the charitys are probebly as overwellmed as cab say they are with enquiries , also the person you spoke to may want to seek clarification on some things.
Just bear in mind that the CCCS have to be factuall and guarded in what they say, there are however many times that deals have been done that CCCS cant speculate on, so dont give up yet, in fact dont give up at all.

Have you already been to Court about the arrears? If you haven't then you're not really at any risk at all.

No Richard, we haven't been to court yet about the arrears,
When we initially fell behind, the mortgage company went for a repossesion order but we were able to stop that by offering them an extra £105 a month on top of the mortgage repayments, we have now defaulted on that arrangement and not paid the mortgage or the arrears since April which is why they have written to us asking us to phone them ASAP to discuss.
Another instalment is due on 15th June and I don't know what to do?0 -

Apologies for not being on line today, I'm afraid work is getting in the way of doing something useful.
Can you afford to pay another installment? If not then it's an easy decision to make. The bank / building society are months away from the point where you stand any chance of losing your house. Your priority at the moment is addressing your unsecured debt so that you can get back in control of your finances.
I can appreciate you want to get this behind you as quickly as possible, but these things always seem to take longer than you'd like them too. Uncertainty is an awful thing for anybody to bear, and I think it's fair to say that most people on this Forum have suffered those agonising moments when you think that you'll never laugh again.
Has your O.H's approach to your problems improved at all?
The indecision before actually declaring bankruptcy seem to be the worst for everybody, but once you decide what you're going to do, it will get better.
