Mrs Dee, i have no idea what the courts would say if your husbands ex took him to court, but under CSA rules only his income would be looked at. Your wages would be ignored completely. He is quite able to make an application himself to the CSA for them to do a calculation on how much maintenance he should pay, the court would not be able to override it. If he then wanted to pay more than the assessment he could, but it would be voluntary and no matter how much she may moan the CSA could not enforce more than the assessment they had made.
You personally + financially would be out of the loop entirely

Are you sure on that. My husband was told that if he had lots of back pay once the child hits 16 or 18 depending on if they stay on in education. Any back pay will be wiped.
And the CSA would no longer be interested as the case would be closed. Might be able to take it to court as it is no longer alive case.

I am not married to my partner.
We stupidly put my name in the forms he got sent recently so they now take my Child Tax credit into account.
My question is ...
Can i ever be removed from my partners CSA file?
What i mean is if we have a change in circumstance (new job might be on the cards) do they then send out new forms to be filled out.
If they do can we get away with not putting my details on the new forms?
It's really winding me up having to give her my money.

Can't say if you can take your details off the forms. But can tell you what happens when my husband deals with the CSA. He is on the old system.
Rings them up tells them. If it is a change in job then they want 5 weekly or 2 monthly wage slips. So if you are earning less money then you be paying a higher amount until the new assesment.
Most times they will want paper work to back it. When I stopped working he just told them. As we where told I had to give wage details otherwise he would pay more.
Personally, I don't see what income you or me gets should have any bearing on what payments your parent or my husband pays, as the parent with care new partner wages are not taken in to account. They are your parents/my husbands children and not mine. And the whole point of Tax credits is because you are family in need.
And of course if the parent with care is on WTC they have a zero rated income.
