Could I get 'done' for Fraud?

I think I'm going to have to hold off from getting a Debt Management Plan (DMP) for a few months, as I read somewhere on here, that it is fraud to get credit when you know you cannot repay it.
Last month, I got a new tesco Mastercard, as I got a 0% for 12 months. I got it thinking it would temporarily help my situation as it would reduce my monthly payments.
I've just paid my first months minimum payment. I'm worried if I get my DMP, and write to tesco, saying I've applied for a DMP, and give them a token payment, they could turn around and 'do' me for fraud????
Has anyone been in a similar predicament, or could advise?

I'm not sure whether you can be prosecuted for fraud or not but I'll be very surprised if you were.
Not sure if you're confusing the fact that you could/will forfeit your DMP while taking on any more credit while in an agreement. :think:0 -

I'm guessing your credit rating can't be bad if you managed to get a 0% credit card.
I have recently looked into a DMP by completing the questionnaire thing on the CCCS website. To be honest, it scared the bejesus out of me and decided it wasn't for me. That was earlier this month. I've knuckled down and sorted a lot of my finances so I know who I owe what to, when the payments are due, how much they will be etc. If you've ever heard the saying "knowledge is power" I would say it is never more true when applied to your own finances!
You can do the CCCS questionnaire completely annonymously and you don't have to go any further with it - I'd do it just to see what they advise. I wouldn't do as they suggested because I have debts which are on low APR's and am willing to pay minimum payments to them whilst I make overpayments to the higher rate CC's. With CCCS they request that you include every debt and not have any more credit until your DMP is finished. I couldn't guarrantee that I could live on what they suggested I lived on and I felt as though I'd be even more out of control than I am now. Having said that, it does seem to work for many people.
Maybe if you post your SOA (statement of affairs) we could help you to revise your expenditure and maybe knock a few quid off here and there. It's much more difficult for anyone to offer help and advice without knowing all the ins and outs. I've seen so many people on here helped beyond their wildest dreams by posting their own SOA's.

IANAL etc etc but the only cases that have made the newspapers about "fraud" that I have seen are absolutely blatant i.e bloke with criminal record obtains cc and then hits it for every penny and some more. I do not know the answer but feel that if you have filled in all the questions truthfully then you have nothing to fear. But please do not rely on me absolutely.

Your simple answer to that one is "you had your lightbulb moment and you took advice, and CCCS or whoever recommended a DMP".
I doubt very much Tesco will do anything to you. Who Is doing your DMP, ask your advisor, I am sure they will tell you the same.

There are people who are forced due to circumstances to pay the fees for bankruptcy by withdrawing these on a credit card on the way to court. That's a naughty thing to do, but it's not fraud.

The first payment had to be the full agreed amount and the 2 and 3 payments could be token payments. Once the 3 months had passed she was allowed to commence her DMP.0
