BRO / BRU's - how common?

    It seems there are a lot of us on here worrying about this same issue. However, from the cases I read on that link, it seems that many of them had recklessly taken more debt in order to enhance their standard of living or fund gambling etc.

    To be honest, nothing I've read on this thread seems to fall into that category.

    Having read a couple of the instances of those BRO links. Can anyone advise me if I'm likely to recieve a BRO due to the fact that for 10 months I have not paid any payments to creditors. I have been trying to save for BR + suffer from mental illness and buried my head in the sand. Ive got a letter from my consultant to support the latter. Because ive seen it as so out of proportion, ive just buried my head in the sand. I spent 2 yrs writing letters to creditors, calling, negotiating, CAB did so too but I would make token payments and still get the late fee, interest and so on added on, and i was making the token payments at the expense of paying my rent. I changed this 10 months ago when I was nearly evicted from my housing association flat (i really cannot afford to rent privately) so i prioritised this over my debts. Would i be likely to get a BRO?

    I didnt pay any of my creditors for nearly two years, and I have a mental illness and there wasnt any problem indicated by the OR, although I have only been BC for 5/6 weeks. I had my interview and havent heard anything to make me worry (the OR said I wouldnt hear anything, and things will be moving along). I did explain when I had my interview (at the very beginning) that I had Mental Health Issues, and to bear that in mind if I ask for stuff explaining or repeating as things dont always click first time around. My OR was very understanding and was happy with my explanation.

    I really understand where you are coming from, and you have my understanding, my advice would be go bankrupt and be honest with the OR, looking at the IR about BRO/BRUs you would have to do something very extreme to have one. Although every case is different, and who your OR is also factors into the decision process. Unfortunatley there are no hard fast rules only guidance that the OR has to follow.

    One encouraging little tidbit I've found is that even with a BRO/BRU in place, you are still discharged after a year. The restrictions of bankruptcy continue to apply, but that's it.

    Having been an avid reader of this forum for almost a year now, I have yet to see anyone get a BRO/U, despite many, many people worrying about them :)

    Maybe one of the longer term posters could confirm if they've actually known of anyone on this forum get one?

    Fatbelly's post no. 3 is pretty sound advice - unless you've been guilty of any of the circumstances listed there I really don't think you've got anything to worry about :)

    I've been posting on this Forum for two years and I only remember one case of somebody receiving a BRU/O. The guy had taken out a sizeable loan just before going bankrupt and couldn't "remember" where it had been spent.:rolleyes: :rolleyes:

    In the belief that we could avoid bankruptcy I took out a loan 3 months before our bankruptcy, and paid for two holidays on a card, and there were a few raised eyebrows, but no BRU/O.

    Why does the OR leave it until a bankrupt is virtually on the home strait (6 weeks prior to discharge) before dropping a BRO on them?
  • I still dont know if I will get one, waiting for my banckrupcy to come through still. I got a loan in Feb / March time for 2K, I already owed 20K but hadnt paid anything for 2 years, so figuered I had more than enough time to pay this loan off, I need a cooker / micorwave / telivision for the kids, everything broke in the house at the one time. My biggest debtor at the time was RBS, whom I owe 9K to, but they owe me 5.5K in bank charges, so I argue that I dont owe them and it should be written off mutually. the other was council tax which I know they have 20 years to chase me for so wasnt overly concened. I still think I might get a BRO/BRU, I shouldnt have taken out the loan, but I didnt know what else to do at the time.

    I just had a letter along with being told that my van would be exempted from my BR now saying that at this time with the information they have they are not considering and BRO/BRU or IPA but may ask me for further information in the future. I dont know if anyone else have had this. Do they ever re contact you and ask for a new SOA to check to see if you are earning enough to do this? or are they just covering there backs?

    but if you look at the BRO/Us some people are seriously hiding money without giving reason, there was one who withdrew 15k from his house sale and said he gambled 10k in a casino and chucked 5k in the river, total rubbish that cash had been stashed, they deserved a BRO, as for buying a cooker ect, its kinda of justifiable and if you have a paper trail to it you may get a sympathetic ear from the OR.
