SOME ADVICE ABOUT SPEAKING TO DCA's

Hi all,
I have read various forums here about not speaking to Creditors/DCA's but to ask them to put in writing instead. Despite me banging on, going over the same old ground time and time again about when the money will be paid, HSBC still continue to phone and harrass me. (sorry for the tone used - it makes me angry). :mad:
I agreed to pay my debt back to HSBC (i took out a 2nd mortgage to do so) but they decided to close my account 24 hours prior to the money going in. So in effect they moved the goal post.
Today I have received 3 phone calls from HSBC, each time I've said "put it in writing and delete my phone numbers" to which they've said "sorry we can't do that" - is this correct?.
I'd appreciate any help or advice anyone can give me, I'm really trying here to sort things out - but they just seem hell bent on pestering me. Thanks in advance.

Have a read of this while I ferret out weller's letter telling them to communicate in writing only.
Also refuse to answer the security questions for a a start.

I would suggest that you both read this and if they continue to scare you, report them to the Trading Standards as they will be acting in direct contravention of the OFT Guidelines for Debt Collection:

Harassment by telephone
FORMAL COMPLAINT UNDER THE CONSUMER CREDIT ACT 2006 COMPLAINTS PROCEDURE
Account Number: XXXXXXX
I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls. (Delete if necessary)
I now require all further correspondence from your company to be made in writing only.
I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.
Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.
Be advised that any further telephone calls from your company will be recorded. (**Even if you don‘t yet have recording equipment!!**)

Many thanks RAS, I have seen this somewhere before so will be sending this tomorrow by recorded delivery. I was concerned that I may be acting illegally by sending this, can I still send it even though it is HSBC and not their DCA's? - who by the way are yet to make contact with me.

Strictly this letter is for DCas.
If you are still with HSBC, use the basic components to demand that they write to you because of the problems caused by their decision to close the account despite verbal agreement to pay the money.If you've have not made a mistake, you've made nothing0 -
After the hoo-ha last week after they had closed the account, I refused to speak to them, purely and simply because they do not listen. Since I probably already have a bad credit rating and the fact that the money is now in an account held elsewhere, do you think I should offer say 40% of the total balance? I have 'played ball' all the way along, taken all the flack and the 'peering over the glasses' attitude from banking staff!. As you can tell in my tone of writing (for which I apologise) I am very upset.
