this morning I put my 1st ever post on debt free wanabees, people have pointed me in the direction of this bored which I have already found useful, reading other peoples threads.
I have decided that bankruptcy is my only option. At the moment me and DH have around £30000 debt of which about £27000 is in my name.
I dont see how we are ever going to be in a situation where we will be able to pay this money back.
Not taking the debt into account our monthly SOA already shows a deficit just from paying priority bills and arears.
I am currently trying to find the money to go bankrupt which isnt easy.
Does anyone know if everything in our house will be looked into by the OR or just my things. For example A lot of the things in our house DH bought before he even ment me.
Also people havbe told me that although I will have my car taken away I may have money to by a smaller cheaper car as i need it for work. Does anyone have experience of this.
And finally our sofa's were bought 18 months ago on my credit card, will the OR leave us sofaless?

If you have a new 32" plasma screen or a few odd Picassos tucked away, you should expect the OR to take interest in them Otherwise....
As for the car, it seems to depend a bit on the OR. Some will take cars at around the £2000 mark, others have taken cheaper ones. However, if you need a car for work, then you will be allowed money to buy a cheaper replacement.
As for fees, Stop paying all the debts in your sole name and save the money towards your fees.If you've have not made a mistake, you've made nothing0 -

if only it were that simple i havnt paid my debts in about 4/5 months now any way. We simply dont have any money left over each month to save for anything
my mum is currently having to cloth my daughter and get her new shoes every time her feet grow. 0 -

This depends on the OR, you will need to prove to the OR that it is essential for work, if he/she agrees they will either let you keep it, make you buy it back for a reduced amount or possibly take it and allocate some funds from the sale to you to buy a much cheaper one... it's basically upto to prove you need it and cant get by without it
And finally our sofa's were bought 18 months ago on my credit card, will the OR leave us sofaless? No, the OR won't take these unless they are really expensive ones, they will not take any normal household goods. If the OR felt y ou spent irresponsibly they may impose a BRO but not very likely

dh does have a big plasma tv and a games console, both are over 2 and 1/2 years old now, we have looked at selling but for the money we would get for them compared with the £30000 we owe it seemed silly as it wouldnt get anyone off our backs and we would be sat with no tv to watch. do you know if OR will take these things0 -

to be honest i wouldnt mind having a pre payment meter for utilitys I dont think bankruptcy will take them into account though as they are all in dh's name and at the minute we definately cant afford for him to go bankrupt as well0 -

Are you acquainted with www.freecycle.org? If not, sign up for your local group. Like e-bay but the stuff is free. Great for kids and adult's clothes, short-term replacment electrical kit that has broken down, etc.
Reference the TV, if it is in dh's name, then, OR is not going to be looking at it.If you've have not made a mistake, you've made nothing0 -
Ok.. if there in his name then you're right, they wouldn't be included.
