hi all,
ive just received a leeter from above company, regarding a sainsburys cc. they have been sold the debt. ive just spoken to them, regarding my situation (2k in mortgage arrears, cancelled DMP with CCCS to pay mortgage 300 p/m to clear it, so having to offer creditors £1 pm token.) woman at marlin said that my payment to them is now £200p/m:eek:. i couldnt pay this at all. my DMP was £74 p/m. she said as im a homeowner that legal action will be taken and probably a charge on my house.
should i ring CCCS for their advice do you think? i think im still a customer of CCCS only cancelled dmp in november.
one more thing, amongst my letter from marlin, was another letter to ANOTHER PERSON, with his details address, debt owed ect, how embarrasing. i told advisor, who just laughed (i said i dont think its that funny really, i wouldnt want someone to receive my details) and said to return the letter. tut tut

I thought I had just answered this, but I can't find my reply (sorry if it turns out to be a duplicate thread, my head is a bit frazzled today!)
Yes, I would contact the CCCS - I didn't quite understand from the above why the DMP was cancelled, but if you are still a customer of theirs, hopefully they will at least be able to give you some advice.

Might be worth informing data protection registrar that you received someone else's details and ensure you contact CAB for appointment to sort out debt repayments and get interest suspended. CAB don't charge for debt advice.

have spoken to cccs, who just advised me to ring them if i get court papers. snaggles, my DMP was cancelled by cccs as when i told them i have 2k of mortgage arrears to have to sort out, they wouldnt continue with my plan, so when my arrears are sorted i can just reapply again. i dont think ive been charged interest, well dont know because ive not had any statements to suggest otherwise.
regards to the letter for a different person, my hub said i should try calling person, i said oh no, i would be dead embarrased if someone rang me!! but have thought maybe i should send it to the person, with a cover letter, explaining what happened. how do i contact data protection??

I would contact the person who the second letter was sent to and tell them of the attitude and encourage reporting them as they have broken data protection and find it funny.
I would also stick to your DMP offer and write a letter with FORMAL COMPLAINT at the top and complain that they are not allowed to ask you for more money than you can afford and there breech in data protection and the employees careless atttiude when mentioned. Also read through the link below and see if they have done anything else againt OFT guidelines, I should imagine then you may find that they accept your offer when they realise you mean business - sometimes we have to play mean with these companies to get what we want!

ive read through and i will take your advice and write them a letter. i need to raise the issue about the letter of other debtor somewhere and the advisors attitude, it seems that they lack care.

hi , many people are requesting there CCA and Deeds of ASSIGNMENT from DCA . This process is explained on other posts. It is a legal requirement under the CC ACT , that you are provided on request ,signed copys. Failure to comply within the set time scale ,in many cases , makes the debt unenforceable. good luck0

just spoke to marlin (a really rude guy called matt jenkins) actually confessed he had just given me a fictitious name i might add,with regards to conversation about other debtor yesterday and them laughing. he sounded like couldnt care less, i said i was contacting the debtor next and the data protection, he said im just trying to cause trouble, then went on how im going to sort out my own debt.
i shouldnt have listened to him,im worked up livid now, as he was going on about why i think i should get away with not paying a decent amount per month (at least £200 pm), and that a mortgage isnt a debt really !!!!!!!!!! i said well, a debt has to be paid every month, so does a mortgage.
these are rogue debt collectors im sure.
ive rang again, explained to a dif department, whom is getting a manager involved. not before time i say!!:mad:0 -
You would have no reason to "cause trouble" if they had not broken the law! Keep that livid feeling they need to be taught a lesson and I know just the person to do it - you!
I promise you when you get what you want you will feel a huge sense of achievement its about time these companies learnt that we are unfortunate with money not stupid and need to be handled respectfully and work together.
I had issue with another DCA, I normally write but this ttime I had two DCA after one debt, as soon as they got my name out of me the woman started shouting, and that is what they are paid to do bully, hence put things in writing and stand firm bullies should never win!0 -
It’s a credit card right? Then it’s not secured against the house. I’m sure they can’t do anything like give you a charge order.0
