October Half Term 2022 - Prize Draw Terms and Conditions

1. The promoter of this prize draw is XC Trains Limited of 5th Floor, Cannon House, 18 Priory Queensway, Birmingham B4 6BS (the "Promoter").
2. The prize draw is open to all UK residents aged 18 years or over except employees of the Promoter or its holding or subsidiary companies, their families, agents or any third party directly associated with administration of this prize draw.
3. The prize draw is free to enter and no purchase necessary, however internet access and/or your own genuine personal Twitter, Facebook or Instagram account are required.
4. All entries must be submitted by fully completing and submitting the online entry form which can be accessed by either;
(a) clicking the URL link within the post advertising this prize draw on the Promoter’s Instagram page (@CrossCountrytrains) or Facebook page (http://www.facebook.com/CrosscountryTrains); OR
(b) clicking the URL link within the Promoter’s email sent on Monday 24th October 2022. Please note emails will only be sent to those individuals whom have previously signed up to receive marketing correspondence from the Promoter. If you have not signed up to receive marketing emails from the Promoter please enter using the method set out at condition 4a.
5. Only one entry into this prize draw per person is permitted.
6. The opening date and time for entries is 12:00 pm on Monday 24th October 2022. The closing date and time of the prize draw is 11.59 pm on Wednesday 2nd November 2022. Entries submitted outside of this timeframe will not be valid.
7. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind.
8. There will be 2 winners of this prize draw who will be chosen by random draw performed by a computer process on Thursday 3rd November 2022 (the “Draw Date”).
9. The prize for each winner will be:

• Four Standard tickets for a return journey with CrossCountry on the CrossCountry network (https://www.crosscountrytrains.co.uk/stations-destinations/route-map).
• Four tickets for each of the activities set out below at the Bear Grylls Adventure Centre in Birmingham, further terms and conditions apply to this proportion of the prize and it is the responsibility of any winner to familiarise themselves with such please see the footnote* to these terms and conditions and https://www.beargryllsadventure.com/ for further details:
  1. iFLY,
  2. Archery,
  3. Climb, &
  4. Unlimited use of Assault course.
  
  10. Dates and times for rail travel are subject to availability and when claiming their prize in accordance with condition 12, winners must give the Promoter at least 10 wording days notice prior to the intended date of travel. All travel must be completed on or before [Friday 30th June 2023] and all travel is subject to the National Rail Conditions of Travel (http://www.nationalrail.co.uk/times_fares/46427.aspx).
  11. Any costs incidental to the fulfilment of a prize other than the delivery of such by post in accordance with these conditions are the responsibility of each winner.
  12. Entrants will be notified if they have been selected as a winner by email (using the details provided on entry) no later than Monday 7th November 2022. When notifying the winning entrant, the Promoter will issue a claim form which the winner must complete, specifying the intended dates of travel and return to the Promoter in order to claim their prize. It is each winner’s responsibility to ensure that they provide the correct details on the claim form.
  13. If, pursuant to condition 12, a winner does not respond to the Promoter to claim their prize by completing and returning their claim form by Friday 11th November 2022, then their prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
  14. The prize will be sent to each winner by post within 5 working days of the Promoter receiving that winner’s completed claim form. Winners are responsible for providing their correct postal address and the Promoter will not accept responsibility for any lost prizes and replacements cannot be sent. Prizes will not reach any winner before Friday 11th November 2022.
  15. The prize is non-exchangeable non- negotiable non- transferable, and no cash alternative is offered.
  16. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
  17. The decision of the Promoter regarding any aspect of this prize draw is final and binding and no correspondence will be entered into about it.
  18. The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will send the surname and county of major prize winners and, if applicable, copies of their winning entries, to anyone who writes to the address set out in condition 1 (enclosing a self-addressed envelope) within 30 days of the Draw Date stated in condition 8. If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at the address set out in condition 1. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
  19. Participants are deemed to have accepted and agreed to be bound by these terms and conditions upon entry. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these terms and conditions.
  20. The Promoter reserves the right to hold void, suspend, cancel, or amend this prize draw where it becomes necessary to do so.
  21. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate any winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up their prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
  22. Personal data provided by you in entering this prize draw will be processed by the Promoter for the purpose of administering the prize draw. Entry to this prize draw will be deemed as your consent to this processing. If you do not wish your personal data to be processed in this way, please do not enter this prize draw.
  23. Personal data supplied during the course of this prize draw will be passed on to third party suppliers only insofar as required for fulfilment/delivery/arrangement of the prize. If you do not wish your personal data to be processed in this way, please do not enter this prize draw.
  24. Any other processing of personal data (other than as set out at conditions 22 and 23 above) supplied during the course of this prize draw will only processed as set out in the promoter’s privacy policy https://www.crosscountrytrains.co.uk/privacy-policy. Please also see condition 18 with regards to the announcement of winners. If you do not wish your personal data to be processed in this way, please do not enter this prize draw.
  25. The prize draw is in no way sponsored, endorsed, or administered by or associated with Facebook or Instagram and entrants hereby acknowledge and agree that Facebook and Instagram have no liability whatsoever in respect of these terms and conditions nor the prize draw to which they relate.
  26. This prize draw shall be governed by English law, and the parties submit to the jurisdiction of the English courts.

*Terms and conditions for the Bear Grylls Adventure activities:

• For iFLY: Participants must be 8+ years. 8 and 9 year olds must be accompanied on the activity by an adult aged 18 or over. This adult must have a full activity ticket. Guests aged 10-16 years will need an adult present at check-in to sign waivers, but can enjoy the adventure unaccompanied. Parent or guardian accompanying those aged 10 to 13 is required to remain on site. Maximum weight 114kg. Maximum height 204cm. Those who have previously suffered a shoulder dislocation will not be permitted to fly. A risk declaration form must be signed for iFLY
• For Climb: Participants must be 8+ years. 8 and 9 year olds must be accompanied on the activity by an adult aged 18 or over. This adult must have a full activity ticket. Guests aged 10-16 years will need an adult present at check-in to sign waivers, but can enjoy the adventure unaccompanied. Parent or guardian accompanying those aged 10 to 13 is required to remain on site.
• For Archery: Participants must be 8+ years. 8 and 9 year olds must be accompanied on the activity by an adult aged 18 or over. This adult must have a full activity ticket. Guests aged 10-16 years will need an adult present at check-in to sign waivers, but can enjoy the adventure unaccompanied. Parent or guardian accompanying those aged 10 to 13 is required to remain on site.
• Pregnant guests are not permitted to take part in any activity at The Bear Grylls Adventure
• Prize does not include costs for drinks, meals, accommodation, transportation, travelling expenses, excursions, treatments, hotel charges, room service, phone calls, personal expenses, insurance and parking.
• Valid on any date the attraction is open.

• All guests participating in an activity need to complete the general attraction waiver. Please note that you will complete this form on site on arrival, so there is no need to print and complete ahead of time.
