    You may be able to show that petition to the judge. I am not sure about that but I think that you can take a tablet into the hearing. Their rep will probably object.

    Sorry where do i mention that and where do I put the evidence that others are having similar problems? In the Defence or the exhibits? 

  • Did you try to make payment by RingGo. I think you first have to set up an account and then make payment. By the time that you have done that (if you can manage to set it up) you will have gone over the time allowed to park.   

    Their argument will be that the driver should have moved to another car park which they did but went over the time.



    Ring go wasn't an option when I tried. It was a website that I was directed to.

    My argument is that I'm still in the "consideration period" (para 13.1 IPC COP) until the moment it became apparent that I was unable to perform a contract. I would never have driven on to this carpark had I known it had been taken over and there are no signs from the outside to advise this was the case.

    Have you complained to Trading Standards abot this?.   
    You never know how far you can go until you go too far.

    I would mention it in the defence but show the actual evidence in the WS. The WS is the story of what happened in the first person and you can add exhibits and photographs. I thought that in one case someone had taken a tablet so I think that it is possible. Might be best to produce it for the WS in paper form but take in tablet if you are allowed to. There has to be some serious issues for people to start petitions. 

    I would briefly mention it in the defence because I don't believe that the DDJ's will always have time to read the WS in detail. I have seen 10 minutes reading time allocated to these claims and Excel sent me 80 pages in their WS. Don't be put off by that. It is mostly irrelevant twaddle.

    You can refer to exhibits in the WS during the hearing.

    Yes, you need to briefly say things in the defence that you will later evidence and expend on in the WS and at the hearing.  Your defence must mention everything you intend to rely on.

    The reason for admitting being the driver is, in a case where your defence is as specific as yours, it's impossible to have any credibility when talking in such detail about what happened, including showing bank evidence, if you are pretending not to be the driver!

    You'd tie yourself in knots and look like a far less honest witness, if the Judge just cleared their throat and asked 'were you the driver?'

  • Through the CAB consumer service I have submitted a complaint regarding Excel Parking (Three Spires ~ Backcester Carpark) to Trading standards.  The more people doing this builds a bigger case to ensue an investigation takes place. 

    You could also contact the person that started the petition as part of your WS.
