They did this with a case in Nuneaton recently (the FB group) and the judge rescheduled.

Fantastic result and equally fantastic court report.The claimant said I didn’t send them my witness statement, too, which is rubbish because I posted it to them.They say this so many times that we now know that they are unequivocally LYING!What surprised me, and what was telling, was when the legal representative upon hearing the judgement in my favour asked about appealing the decision and tried to suggest that the judge came to a decision that no other judge would come to.
Equally, they always instruct their advocate to seek the court's permission to appeal. They never seem to succeed! Oh dear! 🤭

I'm delighted for you Stefano123. Congratulations on your well deserved win. I hope you will be happy to hear that the 2 ladies who followed you to court this morning at Walsall have both won their cases too. The tide has turned for Excel at Three Spires. We know they are cheats and now the Judges agree with us. Was their represented from Elms Legal? They have used this excuse of not receiving the defendant's WS before. The game is up, Excel!

Beaudelicious So pleased to hear that the other two ladies fighting claims as a result of PCN's from Excel on their two Lichfield car parks won at Walsall on Thursday.
It appears to be the same judge as at Stefano's hearing, DJ Loyns.
ab2000 I hope that they will have the sense to not keep throwing money at these claims and they back off but they are arrogant.
