Hello, apologies if this isn’t the correct forum but I’m anxious for some help if at all possible.
Joint home was sold in January. The estate agent we used was horrendous, and so I raised a formal complaint with them. There were numerous issues, and I wanted evidence that they had carried out their offered sales progression adequately, amongst other things. The agent is extremely hostile and combative, so I knew their response would be the same. The ombudsman’s advice was to respond again and await their ‘final response’ letter. Of course, they’ve not offered anything in the way of evidence they did carry out any kind of progression, and actually changed tack in their initial response and have accused me of bullying!
half of the bill was paid. This came out of my ex husbands account because I could only withdraw a limited amount daily. I have refunded him the half he paid. My belief is the debt is joint, but they’ve only submitted a claim for me on the basis that ‘Mr x paid his half, so Mrs x owes us her half’. Firstly, can they do that? It was a joint home, and we jointly signed to use their services.
secondly, the court form has the correct street name but incorrect house number. I was going to purchase the number they have quoted, but changed plot. I’m sure they were advised of this, and I know my purchase estate agent had spoken to them. But, anyway, the summons is addressed to me, but at an empty property. I assume the postman recognised my name and posted it through the door. I’ve never lived in the house they’ve sent it to. Do I advise the estate agents that this is incorrect (I’m loathe to due to their hostility towards me, and the fact they’ve ignored my last letter)?
so, cutting out the waffle which I do when I’m stressed.........should they be also ‘going after’ my ex husband for the other 50% too, and what happens if other subsequent letters go to the empty property and I don’t know about them?
ive never refused to pay it. I have asked that we sit down and they produce their evidence on their system to show they progressed my sale. Other issues have been them giving my phone number to my buyer without my permission which caused 5/6 messages and phone calls per day until I blocked them. They then gave the buyers my ex husbands phone number. They have also used my divorce circumstances against me, and have copied my ex into an email where I had to explain that I couldn’t speak to him because of domestic abuse, and confided that this was advice given to me by my domestic abuse key worker. My ex wasn’t aware I had a key worker, and it could have put myself and my children in danger. I disclosed this in confidence. Now that I’ve complained, they sent him a copy.

What did the Ombudsman say after you raised the complaint with them, has it been resolved etc?0

I have to wait 8 weeks for the agents to reply before I can refer to the property ombudsman. The agents are ignoring me0

Assume there are some GDPR breaches if they gave your phone number out without permission.0

Thank you for moving to the correct board.
they deny they broke GDPR.....apparently i should not have replied to my buyers when I received a message. By replying, I gave them permission to continue, when I finally had enough of my buyers constant demands, the agent then gave my ex’s number. So they started contacting them instead.
I wish I’d looked at reviews beforehand as reviews going back 6 years are awful, especially about this particular person. Everything they have done/not done has been awful, too much to list. The property ombudsman normally won’t deal with a complaint until 8 weeks have passed, but they are contacting the agent for me due to the agent now not responding to me. I appreciate I do owe some money, and I’ve never said I won’t pay it, I do want to know what they actually did v the service they offered before I do. They don’t seem keen to share that info with me, but I don’t want a CCJ against my name either. It just seems they want to come after me, and not my ex, it seems personal if that makes sense?0 -
An update....and more advice needed if possible.
the ombudsman are investigating, they asked the estate agents to stop any action until they have investigated, but the agents refused.
it transpires the agents have sent paperwork for a CCJ to an address I have never lived at. It’s the same street, but they’ve gotten the wrong house number. The property is an empty new build, so I can’t go and ask anyone if they’ve had correspondence for me.If I contact the agent and advise them of the correct address, will I then have to pay 2 lots of interest/fees? I have never lived in this house they’ve sent everything to, there’s no way I would have known about their court claimI’m not sure what I do now? The ombudsman asked them not to take action, they refused but no one told me in time. The court summons forms went to an address I’ve never lived in, so now I owe the bill plus interest etc
