2 CCj's on the same debt

Back in 2010 i had a few financial problems which resulted in me defaulting on a EGG credit card and a ccj was issued ,the debt was then purchased by a debt purchasing agency in 2014 , in 2015 a second CCJ was obtained by the debt purchasing company for the same debt. Is this legal to have 2 CCJ's for the same debt ?

  • If they applied to the court to have it again then yes of course

I am not sure that is correct. I thought you could only get one CCJ per account. Is it possible that the DCA who purchased the account did not realise there was already a CCJ on the account? I think the new debt owner should instead apply to the court for the original CCJ to be enforced. Or maybe that has already happened and is causing confusion?

The 1st CCJ had not expired , it was less than 6 years old the debt purchasing company used there own internal reference numbers instead of the egg account number to get the second CCJ and then marked on my credit file that the original Egg debt was settled and a new entry for the same debt and amount plus court costs under there name. I have paid off the debt in full and now debt free, recently i came across some old paperwork which made me think why should i have to pay a second lot of court fees

A quick search reveals similar cases have been upheld in court, and others have been successfully set aside.

It appears to depend on which judge is sitting.

Is either judgement been chased at all ?

    Edit, just seen above.

You apply for a set aside and make sure you ask for your costs.

Why did you not defend the second CCJ? Was it sent to an old address?

    Interesting

After the EGG card I defaulted on fell off my credit file I requested the CCA (card taken out in 05) and they couldn’t find one. Received a letter saying the debt was still there but they could not enforce it.
