are CCJ's like debts with Limitations Act

Options
I have a question about the limits on collections of CCJ's

I know that an old debt can go off statute after 6 years of not enforced and that the 6 years resets if you pay or acknowledge the debt.

What about CCJ's themselves?

Do they reset if a payment is made towards them?

Does their life get extended if they are taken to high court enforcement?

My story is that I had a joint debt with my Ex, he never paid a penny towards it, the debt was escalated to the high Court and I entered into a payment plan but it was unaffordable so I stopped. The HCEO's have been back a few times but they have not been for at least 18 months.

As the original Judgement was in 2012 I am wondering if this debt is finished by any chance?

No, CCJ’s never become statute barred, they remain active until repaid.

The only exception to that is after 6 years, the creditor must seek permission from the court to enforce the debt further, the court would then decide on the merits of the case.

  • Thanks for info, been discussing with my Uncle, he told me that in his experience they never go to Court but he also said that they never used to seek CCJ for 6 year old debt but now they do.

Been looking at other posts and they seem to suggest that Courts would take a dim view of authorising chasing the debt after 6 years, asking why they have not enforced in the six years.

Considering it has been escalted to High Court Enforcement and they only ever got a contributiin to the HCEO fees (the creditor contacted me and asked how much I had paid and said they got a pathetic amount) will a Court feel that they have had every chance or give them more time?

Also as they escalated the debt to the High Court does that mean that they have to go to the High Court to get it extended?
