HELP !!!! - recruitment agency didn't pay my money

hi there,
my sister was working for one agency and after she stopped they didn't pay her money for the last week of her work and some money for her first week of work. she should get it a month ago . she is not here to speak for her rights so i go and call the agency every day now. they were pretending that they are fixing the problem or saying that her money went into an other account by mistake , that they will cal back ,bla bla bla, but now they just make laugh of people putting me on the speaker, laughing and trying to tell me that they are not responsible of anything and i should calm down.
they should pay her about £200 , she was working too hard to let them treat people that way.
please, is there any way to stand up for rights? money is not everything but to be honnest i feel for consumer revenge

Employment Agency Standards Inspectorate is part of the Department for Business, Enterprise and Regulatory Reform (BERR). The Inspectorate carries out routine inspections of agencies and investigates complaints about agency conduct. The Inspectorate operates an enquiry line 0845 955 5105 (Monday - Friday 9:30 - 16:30).
It would be much better if the complaint was made by the person ie your sister and I'd advise her to carefully note down actual dates and pays so that she has all the facts to hand when she makes the call.
Used to be the DTI who did this (BERR is it's new incarnation) and they do take complaints very seriously. It's likely they would then do a random audit and that should stop them laughing....0 -
cazziebo is spot on, the Inspectorate will take a complaint very seriously, but it must come from the individual concerned.
I made a complaint about DK Associates (Nottingham) when it was the DTI that monitored them. The complaint was that the agency lowered my pay rate because I had left the contract early (for health reasons, so with good reason), and then refused to supply me with a copy of my contract 'because I might show it to another agency'!?!! The inspector tried to contact the agency and they would not respond, so he paid them a surprise visit. Within a few days of this visit I had received the amount owed to me.Gone ... or have I?0 -
i would like to thank you all for your advice. my sister (who is not in england anymore )has just contacted that agency but they again said the same thing that they will call back. if not so we will use your advice, i can't wait to do that because i know she is not the first person who has problem with them.
after what read from you i wonder .... they didn't even send her last payslip and i asked for it !!!!!!! i wonder what if she can't proove that she was working and did not get payed.without payslip... they are very cheeky but i hope the company where the agency send her has some record of people and the inspector could check if the agency was payed by the company for my sister's work.

that particular agency (in leeds)treats people like rubbish and i wish i could write here the name.

Im wondering whether Small Claims court might be a route to take. Dont know whether your relative was working for a third party through an agency, but I would gather evidence that they were happy with her work and then send a letter to the agency stating that unless they pay up, you will persue them in the County Court.
A friend of mine did this and the Court found in her favour. Its really easy and you can do it online.
If they dont pay up, at least they will have a black mark against them when it comes to credit facilities.

Firstly your sister needs to contact them herself, because they would be breaking the Data Protection Act by discussing the matter with you.
Secondly, you need to establish her start and end date and she needs to request a 'Statement of Earnings' from the agency and you can then establish 100% that she has not been paid all monies due.
You would be amazed at how many people call me to complain they haven't had their 'week in hand' when they actually worked a week in arrears so have been paid fully up to date.
As a rule, agencies pay one week in arrears, so she should have been paid at the end of her second week for work done in the first one and so on. When she stopped working she should have been paid at the end of the first week she did not work then no more. she was working for three full weeks + extra hours and saturdays. she finished 26th august. as you say,normaly the agency should pay her one week after she finished, but they said she will get it little bit later because she said she must finish work. as you see it is already a month and she didn't see her money.
yesterday she called them and they said they will call back. they didn't.
she will try again tomorrow and if they still didn't do anything to fix the situation so she will use your advices for sure !!!!!!!!!!:cool:0 -
Did she keep a copy of her timesheet signed by the company she worked for?0
