Terms & Conditions – Win a trip to India and see the cricket there.

1. This competition is open to UK residents aged 18 years or over. Proof of age may be required. Employees (or family members of employees) of any Kia Motors (UK) Limited (“Promoter”) or Sky UK Group company or any agencies involved with the competition and all affiliates of such companies may not enter the competition.

2. This competition opens at 00:00:01 on 2nd June 2017 and the closing date is 23:59:59 on 30 September 2017.

3. You can enter the competition by going onto the Kia Motors (UK) Limited / Sky hub, and following the on-screen instructions. You will need to watch a video and answer a question. A further opportunity to enter will be offered if you follow the instructions to download a Kia brochure. The Promoter does not accept responsibility for network, computer or software failures of any kind, which may restrict or delay the sending or receipt of your mail. Proof of sending is not proof of entry / receipt.

4. Maximum two entries per person. Entries cannot be amended in any way after submission. Entries sent in through agents or third parties will be disqualified. Early, late, incomplete or otherwise ineligible entries will be disqualified. No responsibility can be accepted for lost entries and proof of submission of an entry will not be accepted as proof of receipt.

5. It is a condition of entry that all rules are accepted as final and that the competitor agrees to abide by these rules. The decision of the judges is final and no correspondence will be entered into.

6. Your entry must include your name, address (including postcode), your contact telephone number, and a valid email address. Without provision of a valid personal email address and personal details the person will be excluded from the

9. Prize does not include other personal expenses, including but not limited to: spending money, accommodation extras (mini-bar, room service meals, laundry, etc.) trips, travel/medical insurance, taxes, service charges, or any other service or item not specifically described above.

10. It is the winner’s responsibility to ensure they meet all necessary requirements to qualify to enter India, including but not limited to: having valid passports, visas and being legally entitled to travel to the country. Please note that we recommend you apply for your visa in time.

11. There is no cash alternative to the prize and unless agreed otherwise in writing the prize is non-refundable and non-transferable, and all prizes are subject to availability.

12. The Promoter reserves the right to substitute the prize for a prize of equivalent or greater monetary value if this is necessary for reasons beyond their control.

13. Except in the case of death or personal injury arising from its negligence or in respect of fraud and so far as is permitted by law, the Promoter and their associated companies and agents exclude responsibility and all liabilities arising from any postponement, cancellation, delay or changes to the prize details beyond their control and for any act or default of any third party supplier.

14. The terms and conditions of any other third party supplier will also apply to the prize where applicable. If there is a conflict between third-party terms and conditions and these terms and conditions, these shall take precedence.

15. The Promoter will not be liable for any prize(s) that do not reach the winners for reasons beyond their reasonable control.

16. The Promoter’s decision is final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these entry terms and conditions will be disqualified.

17. Details of the winners’ name and county will be available for one month after the close of this competition by writing to the Promoter at the address below and stating the name and date of the competition.

18. The name, county and photograph of the winners may be used by the Promoter and each of its associated companies for post-event publicity purposes. The winners agree to allow the Promoter to use their name and likeness for advertising and publicity purposes without any remuneration.

19. Personal Data:

19.1. In addition to the use specified above, the Promoter will retain, use and share each entrant’s personal details on the following basis:

19.1.1. for the purpose of administering the competition;
19.1.2. to facilitate the supply of prizes (in this case data may be transferred to other entities for the purpose of supplying the prizes);
19.1.3. where appropriate consents have been received at the point of entry for this prize competition, for the purposes outlined paragraph 22 below; and
19.1.4. so that Kia Motors (UK) Limited (the promoter) may assess the marketing value of this competition.

20. If at the point of entry to the competition you have not opted out of receiving communications from the Promoter, each of their associated companies or any third parties to whom they may pass your information, then your personal data may be used for the purposes accepted by your entry, including direct marketing. All such use will be subject to the Promoter’s privacy policy at http://www.kia.com/uk/privacy/ Your choice as to whether to opt out of marketing communications will not affect your chances of winning a prize.

21. The Promoter reserves the right to extend the closing date or terminate the competition and withhold the prize(s) where events beyond their reasonable control make such action necessary. The Promoter’s decision (as applicable) is final with respect to any aspect of the competition, including the choice of any winner of a prize. No correspondence will be entered into.

22. The Promoter shall provide the prizes detailed in paragraph 8, or any substitutes thereof, as an agent and not as a principal.

23. The Promoter is not responsible if the trip is postponed, cancelled, or relocated due to disaster, government action, acts of God, strikes or labour unrest, riot or civil disorder, acts of terrorism, inclement weather, transportation strike or other events beyond their control.

24. The Promoter may refuse or disqualify any entry (including winning entries) if the entrant concerned or anyone authorised by the entrant to deal with their entry, acts in a way towards the Promoter or their staff which they reasonably consider to be inappropriate, unlawful or offensive. If the winning entry is disqualified the Promoter reserves the right to award the prize to another entrant.

25. Entrants will be deemed to have accepted these terms and conditions and agreed to be bound by them when entering this competition.

26. This competition, and any dispute or claim (including any non-contractual dispute or claim) arising out of or in connection with it shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this competition.
