I'M STUCK-what should I do next?

I don't know what to do now. After being sent a letter from CapQuest about a debt to a bank I didn't know existed, the debt not the bank! I sent the 12+2 day letter to them. They have replied saying my account is on hold while they deal with my request for further information. In another letter that arrived the same day they have said that they have not purchased the account from the bank and so there is no deed of assignment available.

This is where I am stuck. What do I do next?
Carry on with the 2nd letter after the 12+2 days or wait and see what they send me and then negotiate payments.
Are they bluffing?
I'm completely at a loss.
Can someone help. Please.

    If they didn;t buy it from the bank, where did they get it? Have you tried contacting the bank direct and asking them about it? Does it show up on your credit ratng?

    Something soesn;t sound right, especially if they're basically telling you they can't prove the debt.
    This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

  • It sounds to me like they're just bluffing. Go ahead and send the 2nd letter, then if you don't hear, just treat the debt as dead.

  • Thank you so much for your replies. I had a feeling that these letters were intended to stop me doing anything else. I'll now send off the 2nd letter.
    This was a joint account with my husband. We have since split up and both moved to different addresses but they have traced only me.
    I will not acknowledge the debt because I knew nothing of it. My former OH dealt with all the household finances, I know how stupid that was now, and he assured me when we split up that there was nothing outstanding on the account.:mad:

    A quick update.
    Yesterday, I received a letter from CapQuest with arather bad photocopy of the declaration that we both signed when opening the account. The box for no overdraft is clearly ticked, although the rest of it is hard to read in parts,so this is in no way a credit agreement.
    Where do I stand now?
    Is the fact that they've supplied this enough for them to be able to collect the debt or do they still need to supply a deed of assignment, which they have already stated they haven't got?

    What should I do? The 12+2 days expired on the 26th

    I've now spoken to my former OH and he's agreed with me that there was no overdraft on this account so therefore there isn't a credit agreement.
    The only way that we could be in debt to the bank is if this is charges.
    So do I give CapQuest the time to come up with the statements to see what this debt is or stick with denying the debt as they've admitted no deed of assignment?
    Does anyone know please?
