Claimant won't give payment info

Hi, I went to small claims court last week and the judge ruled that I must pay the claimant £2725. This is all fine and I have the money ready to send over. I don't want a CCJ so want to pay within the 14 day period.

However, I have contacted the claimant by text (definitely correct number) and his wife by text (also correct) to obtain these details and have explained that I need them so I can transfer the money and they are ignoring me!

Any advice on my next move? Other than delivering the money in a mound of 2ps on the back of a tipper?! :)

    do you know their address? you could send a cheque or bankers draft

    Contact the court ? At the very least, this shows that you are ready and willing to pay the money, if the claimants can't provide details then at least your name is in the clear as far as the legal system is concerned.

    I certainly wouldn't be relying on text messages for something as important as a potential CCJ.

    ( Oh, and 2p pieces are only legal tender up to the sum of 20p, so you'd be shooting yourself in the foot on that one :) )

    Did you research a defence properly ?
    And appeal would be worth a punt, in county court the law goes out of the window and decisions can be very random.
    In appeal court the law has to be followed as case law dictates.

    PS the person to "pay" is on all the court papers where it says "claimant or plaintiff"
    You send your payment to that what is listed only.

  • I have looked into appeal but I was put off as I read that I could only appeal for certain reasons, one being that the judge made a legal mistake and as far as I read I don't think I would be granted permission to appeal, the judge seemed biased and on no evidence whatsoever granted in favour of the claimant....

    I would be concerned about a bankers draft as the claimant is my dad and they are not after the money, it's more a case of dragging me through the mud. I would be concerned that if I hand over a bankers draft to them they won't cash it, they can be very nasty

    Damn it on the 2p thing? And there's me thinking I could win that way ;)

    I am going to contact the court tomorrow, it's an unusual circumstance and I cannot find any advice online.

    I sent a text and asked for their email so we could arrange a transfer with proof etc, I know I cannot rely on text messages here, I need evidence and trails to show I am willing to hand this money over.

    Email is not very reliable as proof and is much easier to spoof than a text message.

    I'm 99% sure you can pay the court and leave it to them to get the money to your father.
  • I'm not being funny but if this owed to your dad how can you not have details as to where he is and so on ? , I would presume that in order for you to owe the said money things must have been harmonious at some point otherwise what is the money for ?

    He does know where he is, and what his phone number is. He doesn't know his bank details and wants proof that the money has been paid.

    (BTW, what do people mean when they say "I'm not being funny"? It's usually obvious that they are not being funny, in fact it usually proceeds a statement something like "...but you are being a complete muppet".)

    If that is your take on the wording fair enough, I am implying that they know the whereabouts of the father so paying this off will not be difficult unless the OP is trying to make it that way.


    I could also say that you adding BTW is seen as rude but would not stoop to your level. :)
  • I'm not being difficult, I know where he lives, I have his mobile, his land line but I need his bank details to transfer the money so there is proof I have paid...I have the money ready and want it over with, I cannot simply post it through his letter box in an envelope, that would be stupid! Lol I'm going to phone court now, hopefully I can pay them...will update shortly :)
