Settlement help MKDP won't negotiate

I am in a CCJ for a debt of around 2800 now owned by MKDP. I spoke to them today to offer a settlement as my sister has offered to pay off for me. I offered £750 (thought best to go in low) and they said they will not go lower than £1740 which is more than my sister has got. I am about to have a baby and am not going backntonwork until both children start school. They said they are happy to take my £1/month for all that time rather than anything lower that £1740 to settle. Not sure what to make of that! Is there anything more I can do? Thank you x

    Hi,
How much did the court set the repayments at ?

  • Give em £1 per month then, try again in a year or two and see if their resolve has weakened.

You are lucky to get any discount on a ccj.

They have the usual enforcement options. Take their offer of £1 per month in this case.
  • Repayments were set at £1/month by the court.
My sister has offered to clear all of my debts (if they will accept her proposed settlement figures) but she will only do this if I clear them all so there is no excuses for continuing or getting back into debt. This one is more than she can afford at the £1700 figure so just wondered if there was anything else I could try? I don't really understand why they would rather take £1/month. Even to repay what my sister has offered would take 62 years if my maths is right?! Has anyone had any luck negotiating a lower settlement with MKDP? Is it company policy or is it because it's a CCJ they won't go lower? All the others have been willing to negotiate. I owe £13k in total.
    Thanks
  • Have you considered bankruptcy? This would make the ccj's non payable and would only cost £750, I believe.
  • Seems silly to do that when my sister is offering to clear everything :/
  • Am I missing something? How are they not negotiating? Have they not offered you a £1,000 discount?

    Bankruptcy fees are £705.

I don't think it's silly to take £705 of your sister's money to clear your debts completely instead of several thousand pounds with no guarantee that everyone will settle.

It's unusual for courts to order £1 payments. You must have been very convincing in your paperwork in having no surplus income and nothing to enforce against.

In which case (no surplus income, 13k debt) you may qualify for a DRO (£90 fee, payable in instalments at the Post Office) - you would need to not be a homeowner and not own a car worth over £1k
