What would happen if I destroyed my medical record?

OK I am currently in the process of trying to get some information removed from my medical record....Unfortunately I haven't had any joy so far....So I was just wondering what would happen if I refused to give it back?

Give what back? You'll find you only have a copy. You can destroy that copy..it's yours.

  • I have an appointment this week so I was thinking of asking to see my record then walking out with it...

As above, your notes will be computerised. Are you planning to hack the system?

What is the issue with the information you want removed, is it incorrect?

Interesting manoeuvre. That could be considered theft. They might call the police. It'll probably end as NFA though. You certainly won't be welcome back. My guess is most of it is still stored on computer and taking the GP's copies won't achieve anything.

  • Thanks for the replies folks....Just to clarify this isn't my GP record...

According to the trust my information is held in paper format. The only information they hold on the electronic record is demographic data and details of my appointments etc....

Notes and still made on paper but everything is now scanned and stored onto computer. As someone who works for the NHS I can tell you we have a LOT of paperwork and constantly have to duplicate info for each patient. So even if u did manage to get hold of what you wanted, chances are this thing has been recorded elsewhere...You would be better off requesting to see your records (you will be given a copy) then making an appt to discuss whatever it is you are not happy with

  • I'm guessing you might get arrested - since it isn't your medical record - it's the hospitals medical record about you

Why are you trying to get information removed? Is it inaccurate?

So this is not your GP, nor your summary care record?

If you wish to continue to see the consultant, I would strongly advise against this action. It is also likely that the consultant will suggest you make a formal access request, so the files can be checked over first (in case of information that may be harmful to you or others), and because they don't have time to sit around whilst you play games.

Do you want help with the removal of information, what is your reason for wanting it removed?

Is this a matter of removing evidence to facilitate the taking out of an insurance policy to cover a pre-existing condition ?
