Paragon by the short and frustrated curlies

Options
Hi all
I am having trouble with Paragon also, sadly in or around 2005/06 my ex wife forged my signature on a loan which was £46000 to which my house was tied for the 25 yrs of the mortgage. This only came to light when the British Consulate contacted me on behalf of Paragon who had discovered I was serving overseas...! My ex wife. Had not paid the loan for a long period and they were now pursuing myself, I was unaware and sought legal advice, I approached Idem Servicing (part of paragon) to ascertain the extent of the damage. I was informed £68k was outstanding, but they would look into the factihadsaid the loan application was fraudulent. I forwarded signatures etc, weeks later it came back that as my signatures provided (passport, forces ID card, driving licence, UN ID) were more than five years since the original loan was taken out, they couldnt accept them so I would have to pay up. Warwickshire police also turned a blind eye to it all along with the fact I wasn't aware she had moved tennants into our house (where I believed she was living), and was keeping the rent each month whilst not paying the mortgage of which I gVe towards also... Paragon said they had original transcripts of a phone call made to clarify details...... I am so annoyed army ex wife is now in an IVA and although jointly named in this debt on my payments show on the statements, how can this be fair and secondly what happens to any money paid into her IVA and surely if a third of her debt is written off surely that should come off the total balance....confusion reigns....any one offer any advice.....? I am due to leave the forces soon and don't want to use my hard earned gratuity on a fraudulently gained debt... Also I am to go to uni to study nursing with only a small military pension to fund m e through at present..... I'm heading towards bankrupt options as a tad lost to what to do moving forward.......
Thanks in advance Js

No need for multiple posts but what a miserable position to be in!

Any idea what that huge loan was spent on?
As the loan is in joint names the loan is Joint and Several, which means you are both equally responsible to repay the entire loan, this is why it will not be included in her IVA. It will be ignored as they have you to chase for all the repayments.

I wouldn't bother trying to deal with Paragon directly, they are never going to roll over and write it off, you need proper legal advice. Which ever arm you are serving in will have this facility available to you.
For the RN the White Ensign Association for example provided a barrister and his gang to help me with a dodgy CCJ raised against me. It's free for you so make use of it.
  • The Load was I believe spent on consolidation paying off debt accumulated without anyone knowing, using credit cards etc to live off etc.. There was certainly nothing to show for it. I had legal advice whilst overseas but when I rang recently I was told once back in UK I was to look for and pay for own legal advisor etc. I've been paying it off steadily and have paid around 30 k since 2012 across several inserted debts but as you can Imagine it's frustrating when my ex sees to I've the life of Riley etc........ Oh well battle on I suppose thanks

    That's women for you lol.

The trouble is that she has already convinced everyone she needs to convince that she has no money, hence the IVA so even if you should gain a victory, you still won't get any money out of her.

Ironically you need to be looking closely at your pension as she will have a claim to it, just to rub some salt in.

I lost the lost in my Divorce when I left the Service but I did keep all my gratuity and pension so had enough to start again.
In my opinion, the sooner you cut all ties and accept what has happened the sooner you can start laughing again.
Even if it draws out to a victory, don't underestimate the stress involved, it costs more than money.
  • Pension is safe my friend, as she had a mil pension too albeit small we agreed to leave well alone, also she's remarried as am I.... I'll carry on as I am sadly lol you get nothing in life at times for staying legal lol
