CCA's and Bank O/D's

Hi All,
I recently requested a CCA for an old overdraft and have been sent statements but no actual agreement that I have signed.
Have the DCA given enough info or is a signed agreement required for an O/D?
Also, My request was taken verbally rather than me requesting it in writing, Is this acceptable or should I have submitted it in writing? as the same DCA is dealing with another account and cannot provide a CCA so am I still covered by the same regulations as someone who requested a CCA in writing?
All the best

Hi,
CCA requests do not apply to overdraughts i`m afraid.
Different legislation coves OD`s.
CCA requests can only be used to request copies of agreements from loans, credit cards, catalogue accounts etc, not overdrafts.
Proof of an OD debt would be in the form of bank statements, which would be sufficient to prove liability.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Thank you both for confirming that - would the DCA be allowed to read the statements before sending them out and use the content as evidence as it were?

Usually the "proof" would come from your bank, it may go via the DCA, but they will have copies as well yes.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
