HELP!!!!! HSBC/MCS v Lemma's OH
M husband took out a loan with HSBC about 4 years ago. He defaulted on it, it went to MCS and I CCA'd it cos they said there was £20K outstanding. They sent back a perfectly drafted CCA but I was gobsmacked and very angry to see that amost £7.5K of it was a PPI loan against the principal loan.
My OH was clear to me in that he told them in the phone he did not want the PPI cos it was not worth the paper it was written on. That made sense cos we were emigrating and well into the process with the paperwork at the time. The PPI would have been no use to us. he said that when went into the branch to sign the agreement they said he had to take the PPI or they would not give him the loan. So he signed for it.
I have been told that this tactic is a breach of the banking code, but I do not know what to do about it. Has anyone else had this? Were they able to claim? Has anyone got a draft letter I could crib please?
