Tracing pensions when you many not have kept good records

So, I worked for a company that was made up of lots of divisions. Lets call it ABC.

For the majority of my time at ABC I worked for C but my last 5 months I worked for B.

ABC has been carving itself up recently and C has been spun off as a separate company and I've been informed that my pension will now be administered by Capita.

Doing my updates after a change of address I noticed that Capita are saying I stopped working for C in the April of the year I left them rather than the 29th September which is the correct date for C and Feb the following year would be correct for the whole of ABC

In short Capita are saying they only act on what they were told by C and I need to query it with C or the pension tracing service. Pension Tracing Service said to contact "AB" who say they passed all the data to C when they were carved out and in line with data protection they've deleted the data from their system but do have my leaving date for C in 29 Sep

Speaking to C they advise they dont have any records pre their being carved out and I need to speak to AB.

So first problem is my missing monies between April and September which AB agrees it looks like it should exist but say C have to deal with it. Capita have confirmed they do actually have a couple of contributions after April but not all the way up to September

Second problem, when I switched to working in B I didnt sign a new contract, continued under the same benefits scheme etc. I remember there were questions on if I could continue the same pension or have to switch to Bs even though its the same company, same administrators etc. I believe that I did continue paying in after the queries were resolved but AB say they dont have records of it but that if it had been agreed to continue going into C that those records would have gone to C too but of cause C say they dont have anything.

All this happened about 6 years ago and whilst I may have kept some pension letters I doubt I will have payslips etc confirming each contribution.

What is the best way forward when everyone is simply finger pointing and everyone says they dont have the information?

    Stephen Covey once said that "when you teach once, you learn twice". That is the primary reason for my participation on the forums as an IFA.

    No I dont. Not sure how NI records would help? I am really clueless when it comes to pensions.

  • It wasnt opted out of the state pension from memory. It was the sort where its effectively just investment and at retirement you have a lump sum to put into an annuity or such.

    What you have described sounds like a Defined Contribution scheme which does not say whether it was contracted out or not.

    Generally employers pension schemes were contracted out.

    HMRC would know as would your old employer or any scheme documentation / booklets.
  • Well things get a little more interesting.

    AB contacted me yesterday saying that from a pension side they have almost no data at all still as it was transferred to C when they were carved out and deleted from their system as per the DPA (AB administer the pension themselves)

    They did however eventually speak to Payroll who have also deleted records prior to Sep as they were transferred to C as well but they do have the records from Sep to Feb which confirms that despite working in the B division at that time I was still making pension contributions into C as I thought and therefore these details from a pension perspective would have gone to C in the transfer and should have gone to Capita afterwards

    C continue to maintain that AB have all the records and that AB passed everything directly to Capita (Capita themselves say its C that gave them everything)

    Have spoken to TPAS who say it sounds like a mess and they'll look into it but didnt sound happy about it.

    If we are talking about state pension NI contributions then I remember I was given a choice of if to opt out or not and I believe I didnt opt out.

    I would say that I was only circa 22 at the time and didnt know anything about pensions but I'm not 22 anymore and still know nothing about them
