Just after some advice please!
Partner received a court fine which he was paying through Job seekers allowance, he stopped claiming Job seekers as I returned to work and he had to mind the children.
Anyway the next thing he had a visit from Marstons and we cant afford the full amount they want of £1000, Marstons advised him to let it be returned to the courts which it was so he could make arrangements, he then contacted the court who have said he didn't call them in time so they have passed it back to Marstons!
Where can we go from here? Im terrified they are going to take the car and I need that to take the kids to school and get to work!
I unfortunately had to deal with Marstons many years ago and only had the option of paying in 2 instalments but we have no chance of doing that here as I am the only one earning a pretty low wage and tax credits have been cut too, we also receive no other benefits besides child benefit which pays off a loan!

Is the car owned by you or partner?
Have Marstons been back in touch yet? If he has no income and can only afford a token payment then the court should allow him to pay in installments not through marsdens.

Car is owned by him, marstons have sent a letter about it, he isn't working at the moment but the court say deal with marstons

OP, I'd stop paying the loan and get the fine paid off if you can, it is a priority debt!

The amount they are demanding may have gone up but that's not necessarily the full picture. It's very unlikely that Marston can legally justify that increase - standard bailiff fees these days are £75 "compliance" plus £235 "enforcement" (the latter covering the visit(s) made). For any further fees to be valid things would need to have progressed further i.e. seizure of goods, storage, auction etc.

Can you elaborate on what you mean about payments going "straight to" the credit union? What is the actual payment method involved?
Regardless, you can only offer payments you can afford, no matter how much of a fuss Marston kick up.

Basically my child benefit is paid directly to the credit union and that pays my loan off, I only got a loan a few weeks ago so its all tied in. We would like to make an offer of repayment however the court says speak to marstons and marstons wont set up a payment plan! It should be easier once my boyfriend gets a job but at the minute my wages just about cover our bills!0

Im in a new job, they pay for my education, the credit union is savings and loans, they take so much of the child benefit which goes into savings which I cant take the rest goes to paying off the loan, the loan I used to take the kids on holiday, pay for my sons christening and sort Christmas out. They have everything they need from me, from my wages and the tax credits I receive! I think this has veered from the original post. Marstons are chasing my boyfriend for a court fine we want to pay but cant pay all in one go!!!0

I came on asking for advice for my boyfriend who has marstons at his door and u seem to keep coming back to me and my debt problems?
If you must know I havnt had any credit for about 3.5 years, the loan is balanced against my savings so technically I'm not in debt in that respect!
I started using these forums for advice like most people have not to be scrutinised on things that don't really relate!
The fine they are chasing isn't mine therefore it's not my debt! I asked as he's just moved in with me and I don't want them coming here!
I think il delete this post and stop seeking advice!!!0
