Hi guys
Firstly, I apologise if this is in the wrong section, I was unable to post in the CAB section.
Right, So since Feb 2014 I have cleared ALL my debts. This includes a T mobile contract which was half way through.
This is where the problem begins.... I got the contract through BuyMobiles.net. I had an email from BuyMobiles asking me to contact the collections dept, so I did. They informed me that in Feb this year it was showing that I cancelled a contract with T Mobile, which was correct - I paid the remainder of the contract off in full. The lady then informed me that I have to now pay the full cost of the handset in full, to the sum of £480(!). After a few questions from myself I found out that BuyMobiles supply the handset and T Mobile pay BuyMobiles a fee once the line is connected, I was not aware of this. Since I paid the remainder of the contract off with T Mobile they have now taken that fee back off BuyMobiles hence why they say I am now liable as they are out of pocket.
The lady at BuyMobiles said that when I was paying off my contract, T Mobile should have informed me that I may be charged by BuyMobiles. However I wasn't at any stage told by T Mobile that I will be charged.
I'm scratching my head with this and would like some advice with regards where to go from here? If I am genuinely liable then that's fine I will pay, but I'm not sure whether BuyMobiles.net or T Mobile are trying it on or passing the book.
Thanks in advance for any replies...

Hmm. First thought would be that if you paid off the whole remaining contract, without a discount, then it can't be right that you are left owing anything.
Did you literally pay off the full amount for each month outstanding, or did you pay a couple of months line rental in lieu of notice, on a much longer contract?0 -
Fees for cancelling a contract
If you cancel before the minimum contract term is up, you'll have to pay an early termination fee.
In most cases these fees are very high. For instance, if you signed up to an 18-month contract and want to cancel in the second month, you might have to pay 16 months' worth of fees.
In this case it might be worth staying with your provider until the minimum term is up and then calling them to renegotiate a cheaper deal or telling them you’re going to switch.
If you want to cancel your mobile phone contract after your initial contract term is up, you can do so at any time, although most companies require 30 days' notice.
At the moment there are no rules in place that allow you to cancel because of poor network coverage - this includes if you move house to an area where you can't get a mobile signal.
Buymobiles are trying it on, your only obligation was to pay your early termination fee, whatever arrangement they had with T mobile is non of your concern.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Yes I paid it all off in full including the early termination fee. £217 in total. I'm not sure what to do now? Either me, BuyMobiles.net or T Mobile are in the wrong but I'm not sure who0

You can complain to the ombudsman.

Before complaining to the ombudsman would it not be better to try and resolve the issue? I'm partway through a mortgage application and can't afford to get a black mark on my credit file from BuyMobiles.0

No, this has all come about today0

Right, ok, well then a written complaint would be your first step, I would send to both Buymobiles and T-Mobile and wait and see what response you get, if still unresolved, then ombudsman still an option.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards. Hang on... So you cancelled your contract half way through and paid the termination fee of £217 and they want £480 for the handset?
The maths don't add up to me? So you got a handset worth £480 free on a contract which in total was only around £434 ish?
I'm not saying you've done anything wrong but I have to wonder if there is either something you've missed during the sign up or they've massively undersold themselves and are trying to back peddle... What was the contract and what phone?

ok, thank you. BuyMobiles are saying that it is in their T&C's ,so do you think that I should try explaining that I was never told by T Mobile that I would incur a cost from BuyMobiles, also that because I paid T Mobile in full (inc termination fee) then T Mobile shouldn't have withdrawn their fee from BuyMobiles?0
