Are my defaulted accounts statute barred?

I currently have 3 defaulted accounts on my credit profile. yes i linked my old address to where i am now which i cant move out of because i get 50% off market value from september. Now, I moved out of my previous address according to my credit report electoral role 10/2007. from what i understand from what ive been reading for the past 4 hours is that when u first miss a payment and then dont make any payments for 6 years then the account becomes statute barred and not from the default date issued by the creditor. I stopped making payments before 10/2007 i was only 18-19 and sort of went underground. i only joined experian i think 4-5 months ago and have made 1 payment each to my creditors last month but had no contact with them from 10/2007 to lets say january 2014. are my accounts statute barred. if u need any more information then please ask and i will write whatever u need to know as i have access to my credit profile right now. Thank you.

    also im looking on my credit profile and no account is showing past 36 months. theres no information there for any of the 3 accounts before 36 months. Thought that might help. For example i have a debt that is in mkdp llp's name. That account was started 20/11/2006 but the payment or rather non payment history on my credit report only goes back 25-36 months. Please advise me i think they are statute barred but i need to be sure before i cancel the continous payment authorities and direct debits.
  • right now im thinking i should write to the creditors and say something like i believe the accounts are sb and that i need to see proof of when the last payment was made before the default. But really need some of u to help me if possible. Thank you.

    You are correct that the start of the 6 years has nothing to do with when they chose to put a default on your credit reports.

    However, on some types of debt/accounts it's not as simple as saying the time runs from the last payment either.

    You would probably be best off giving National Debtline a call tomorrow on FREEPHONE 0808 808 4000 to talk through what they think the status of each account will be.

  • Theres a loan and a credit card and a mobile phone bill. do u know why credit history is only showing from like 45 months?

    From what you say they became statute barred at the end of last year. I'm assuming these are credit cards, catalogues or loans. An overdraft might not be so clear cut.

    The letter you need is post#6 of this thread. You don't need the blue bit. I think you do also have to make it clear that you are not making further payments because it is statute barred, if that is your plan.
  • sorry to be a pest but do u have any idea why the debts are not showing up on my credit history from the date they were taken out? If the info was there then i would 100% know if they were sb.

    You usually can't tell SB status from credit report info - it's not detailed or reliable enough.

    The reason debts are not showing are that the current owner does not report and/or the debt was defaulted over 6 years ago and has therefore dropped off.
  • Thanks for your help. ive emailed the companies, hopefully it will go well, worst comes to worst ill have to pay but ill ring national debtlline tomorrow c what they say and also ill keep people informed on this thread. i should have some sort of confirmation or rejection/evidence soon. But im cuttin it really thin i stopped making payments sometime on 10/2007 and updated my credit report on 30/10/2013 but didnt make a payment or contact till about jan/feb 2014 so im either really lucky or really unlucky.
  • sorry ive also informed them that i have cancelled the continuous payment authorities and direct debits and that i will be making no further payments. fingers crossed.
