Hi,
I have recently been looking through my CR files and noticed I have a default from Lowell (4 in total) owing them £167 from Vodafone.
I can't remember the exact date as to when I had the Vodafone account but I am pretty sure it was 2007/08...either way Vodafone is not showing on the CRA...
So looks like Lowell have brought the debt from Vodafone originally (date Lowell say I defaulted is 02/11/2011)
If someone could advise as to weather this can be removed from my credit rating as the original debt is no longer recorded in existence...?

Hello there,
The default date should not be changed - even when the debt has been purchased. If you feel that Lowell have altered the date (either on purpose or by accident) you should raise a formal complaint. If they refuse to act upon the complaint, your next step would be the Information Commissioner: www.ico.gov.uk
My gut feeling is that Vodafone's default would have fallen off by now.

So when Lowell took in the original debt they should have kept the same date as Vodafone?
Yes there is no signs of the original debt to Vodafone on there so looks like Lowell shouldn't and can't chase for this money?0 -

Yes. A default is a historic event, it cannot happen twice - as such Lowell should have kept the original date - which, given what you've posted, may have been over six years ago.
Vodafone has a really great representative on this forum called Lee. Try and hunt him down, I'm sure he'll help you get this straightened out.

He can inform them if the correct default date.
You need to contact Lowell, in writing, complaining that the date is incorrect and to fix it or you will be referring to FOS and referring them to the OFT.
Lowell are correct in reporting the default if they bought the account, they should not have changed the date. If you have not been paying, they often do this so you have to write to get it fixed, thus acknowledging the debt and restarting the 6 year statute barred clock.:beer:0 -

Exactly...I'm in a predicament here...
Do I write to them advising they have the wrong date then because I have done this they will then start the 6 years again or just leave it to run off in 2017?
Surely they cant actually take me to court or chase for the money because the account was over 6 years ago and they have just made a random date up because they are TW*TS!
How do I prove that this is an old account?
Can I go down the route of stating I don't know what its about then asking for proof of agreement etc...?

I'd just like to add a little something here, I had a "debt" with Vodafone. Namely a 60GB usage in 3 weeks totalling £900 debt, something that was fraudulently increased by Vodafone (I can say that without fear of slander as you will see shortly)
Vodafone cut me off for not paying this bill, then carried on billing me saying I had kept using the line excessively £100 here, £80 there. This is all while there is 0 usage on the line. Vodafone's argument was it was in their T&C, something I kept asking to be provided with but was never given.
2 years of them failing to deal with the account, even going as far as their CEO Guy Laurence Vodafone decided to sell the disputed debt with no paperwork to Lowell who threatened all their validation checks showed the debt was accurate etc etc etc. The default caused hell for me as I work in finance and couldn't get another job.
I ended up taking Vodafone to court and wiping the floor with them with a judge issuing a scathing judgement about how their bills don't add up, they had added amounts on fraudulently to my bill then tried to bully me into paying after they admitted the bills were wrong and then decided the best way to recoup some money was to sell the debt on knowing it was a load of old cobblers (ok maybe she didn't call it old cobblers but phrase to that effect)
The moral of the story is that Vodafone are useless from the top downwards and will make out you owe them money without looking into matters and their partners in crime the Lowlife Losers will buy up a name on a spreadsheet with a balance owing and claim it's written in stone to shake you down for money.
If it is statue barred or you don't think you owe it do not be afraid to take them to task for it. A simple apology and taking it off your credit file really isn't enough (IMO)0
