Does a mortgage have to be taken out in a persons current name?

or it can be taken out in the persons old previous maiden name ?

The aim is to take out a new mortgage in the maiden name,

For example

MaryJohnson = Name Mortgage applied under
Marry Simmons = Land Registry name

(where Simmons was the maiden name before marriage), Johnson the name after marriage.

In which name are all the supporting documents, such as ID, proof of address, proof of deposit, P60, payslips, bank statements etc?

They will probably determine which name you have to use...

Why are you wanting to take a mortgage out in a name that is not currently being used?

My answer would be it need to be in the current name, maiden name will also be disclosed. Supporting evidence (passport/statements etc) can be supplied in either name but if in maiden name then a copy of the marriage certificate would also be required.

I could be miles out here but im assuming you may have bad credit in your current name, so you want to buy in maiden name? If thats the case it is extremely unlikely to work.

The above are in the married surname.

ACG, who would the marriage certificate have to be given to? the mortgage broker/company ? (which does have the maiden name on)

    The lender and/or broker.

Can you just explain what it is your trying to achieve and why your looking at making an application in a name that is no longer your current name? We may have suggestions on how you can overcome it - the last thing you want is something being flagged up for potential mortgage fraud. That is something that could affect you for years to come.

You might be able to get the lender to write to you with a maiden name but the mortgage and the deeds will need to match your current legal name and it is your solicitors job to ensure this.
