- Did the letters arrived to your new address, or have they been passed on from your late father's flat?
- As for your credit report, I believe if you update your contact details then the DCAs will be able to see that, although if they've written to you at your new address, then it doesn't matter anyway.

Oh, and the statute barred issue - if it has been longer than 6 years since you last paid or acknowledged the debt (if, in fact it's yours), then it's no longer enforceable in court.
So they couldn't get a CCJ for it, although technically you would still owe it, there's absolutely nothing they could do. Even though they will probably continue to threaten court action etc etc.Fritterati Challenge for 2013:

Sorry, i should have mentioned i know the letters are from a DCA (Robinson Way Ltd) which are basically asking if i am me, and if i used to live at my Dads address. They've managed to track me down somehow....little blighters!!!! This debt maybe mine, im not denying that, but i honestly dont know. I've has so many other things to deal with, this seemed frivilous at the time, but now im petrified.
I struggle to make ends meet as it is, and my lawyers fees are gonna be somewhere in the region of 'horrific and completely horrendous' thats another battle i have infront of me...this could be the last nail in the coffin so to speak. I think that these debts maybe SB as explained earlier so my choices are * Wait it out, ignore the letters and pray nothing comes of this ie court action etc * Send a letter saying that im not me.lol. which might put them off a wee bit longer * contact them, explain my situation and hope they take pity on me (which after reading numberous posts on here, i think i have a better chance of hell freezing over)
I can feel my blood pressure going up just thinking about it!

The information i dont want them to get just yet is that i am who they are looking for, until i get some clearance in my head as to what on earth my next step is gonna be

I would just ignore the letters then, for now at least. You've got other issues to worry about - they're not going to take pity on you and until they definitively prove that the debt is yours and not SB, then I wouldn't worry about it for now.
If at some point in the future you think they're going for court action, then I'd send a prove it letter.

Aside of your legal issues - which I hope you get sorted soon - you mention you work part-time and are paying rent of £500 per month.
If you work 30+ hours a week you can apply for Working Tax Credit (16+ hours if you have a significant disability)

If it's Rob Way it's probably statute barred or very close to it. Don't respond until they actually give some info, Fermi is right it's a fishing exercise.
Dont send the prove it as they haven't actually said what the debt is. When they do, send a prove it and see what happens.
Till then, sort out the flat, that should be the focus of your attention not bottom feeding Rob Way.I'm Debt Free :j 2/09/2013

Thank you all for your help....im more at ease now with the whole situation. I need to focus on the property situation at hand first, when that problem has resolved itself, everything else should be plain sailing from then on....fingers crossed!
