Hi there, Im another newbie to this forum, and like so many, im struggling with debt (and life) at the moment.

My father had left me his house in his will, which i moved into with my then partner a year before his death :( I struggled looking after Mum when Dad passed as she had dementia, but like any daughter, i got my head down and got on with it. This unfortunately put a huge strain on my relationship. In 2008, my Mother unfortunately passed away...which ultimately destroyed the relationship, as he couldnt cope with my grief! I moved out short term (supposed to be) to get a break from my home town, he was gonna get somewhere else to live. To cut a long story short, he has now rented my Fathers property out to a friend of his, changed the locks etc...this is being dealt with now through my lawyers. The problem i have now, is i have recieved letters of a debt i apparently had while living there...probably a storecard, as thats the only thing i can think off. Im terrified, as i dont have money to pay this debt off. I work part time which barely pays the bills and im having to fork out £500 rent every month also as i dont have my property yet (hopefully the lawyers will resolve this soon) Could any of you kind people give me help or advice? I'd really appreciate it.

Sleepless nights are back! I cant seem to get back on my feet since Mum died. Why are some people so cruel?

  • Firstly, sorry about your losses. Dealing with grief is hard enough without the added burden of financial difficulties.

    Secondly, what is your Ex playing at? Renting a house out that doesn’t belong to him? I don’t think this will take long for your lawyer to sort this out. I’m no legal expert, but surely that tenant can be kicked out immediately. If you look at the flip side, if you were living in rented accommodation without a lease, and the ‘Landlord’ didn’t even own the property I bet you would be turfed out immediately!

    All I can say is that, even though there doesn’t appear to be light at the end of the tunnel, this will eventually come and you can start to look to the future.

    So sorry to hear what happened.

    I hope your solicitors can sort it out- they will.

    In the meantime honesty is the best solution. Contact the lenders and tell them the situation. it is better to offer £0.50 a week than nothing at all.

    PS your ex partner sounds like a charming person. You are better off without and so sorry about your parents. both of mine are still alive and really do not know I will get through when they are not.

    What to do from here though? Do i ignore the letters? or do i reply? this was 5, nearly 6 years ago, and i understand that there is a time scale for statute barred (is that right?) I'm gonna be a fortune in lawyers bill aswell which is seriously freaking me out. I will pay off these debts (if they are infact mine, they might be his) but in order to do that, i need to get the flat back that is rightfully mines. What a twisted mess!!

    My lawyer is now in the process of writting to the tenant and explaining that under no uncertain terms should he be paying my ex to rent the property, and shes sending a letter to the ex aswell. He has no right, and as you say, What the hell is he playing at? While hes started a new family, enjoying holidays, new cars etc, Im struggling my butt off every month just to make ends meet, and now theres more pressure as these letters have appeared :eek: I honestly dont know what to do. Im not here for sympathy, i just need some practical help and advice from other people in similar situations. Thank you

    has your x been paying rent for the 5 years you were not there if not he owes it. on the debt just ignore for now.
  • No, the property was bought outright! My Father owned the flat, and left it to me in his will. We moved in a year or so before he passed away.

    My ex moved his new g/f in and shortly after that, they had a baby. He moved out and started renting the flat out to a mate of his. I know i seem like a total push over but its more complicated than that.....i left my home town for a while to get a break. We had split in good terms, but the minute he started a new relationship, it quickly became sour.

    The flat, i'll get back which i have absolutely no doubt, but until then, what on earth am i gonna do about this debt???

    My minds going back to dark places, which isnt good. I feel like im sinking further and further away from a life of my own.

    Im scared to contact Robinson Way as im not sure what the debt is, who it belongs too or for how much it is??? Do i just ignore these and hope this becomes statute barred debt ( i know thats not the right attitude to have) but i honestly dont know what to do?

    Any help and advice is truely appreciated.

    Sorry to hear about your situation, but as regards the debt, if its 5-6 yrs old, then its pretty close to been statute barred, if you haven't made a payment or acknowledged it in all that time then to be honest, with all you have going on, you can easily ignore the DCA, they probably know its close to the six year limit, hence the letters, they cant do anything to you, its all bluster to get you to pay, you could write asking them to prove the debt, head your letter "WITHOUT PREDJUDICE" then they cant say you acknowledged the debt, see what they come back with as regards dates etc, let it pass the six year mark your home free, so to speak.

  • Thank you for your advice sourcrates, thats what i was thinking but think i just needed someone to tell me to do it.lol. I dont know what the debt is though, which is worrying...i did have the occassional storecard here and there but nothing like credit cards. I'm just hoping hes not ran up a huge debt in my name and i'll be left with it tarnishing my credit rating.

    Hey, lets face it, i cant give what i aint got, and at the moment, thats money.

    What happens to that debt though? It doesnt just dissapear...will i just get hounded for the rest of my life by letters etc? Im not very clued up on all this, as i have just found myself in this situation in an instant. Sorry for all the questions.

  • If the debt becomes statue barred, they can send you letters for the next 100 years but it will mean chuff all as it’s not legally enforceable.

    If they continue to send letters after becoming statute barred, send one back thanking them for the endless letters as you are using the reverse as scrap paper which is saving you a small fortune! (joke, don’t do this).

    So just ride the storm??! I'm sure i can do that....these are the only letters ive had in brown envelopes, so from now on, i reckon any brown envelopes i get, im not even gonna open them....they'll go through the shredder!!! Fingers crossed i dont shoot myself in the foot with this one.

    Could anyone tell me if i request a credit check, do these companies pass on your information or can information be leaked to DCA???
