Absolutely shaking with anger! Please help! Reserved house, and they sold it!!!

So I have tried to buy a new build property under the help to buy scheme, I went with a horrendous mortgage broker which were dreadful.
I couldn't get me a mortgage, ok fine.
They then went back to the builder and told them that I have been declined and to put the house back on the market. WITHOUT TELLING ME THEY WERE GOING TO DO SO. WHICH HAS NOW BEEN SOLD.
The same day they came back to me to tell me they couldn't get the mortgage, I phoned up head office to inform them I still want the property I have found a another lender, got the AIP and an valuation should be instructed within 2 - 3 weeks.
They said fine, and they will pass on the message to the sales office FOR THEM TO STILL KEEP THE PROPERTY.
Move two weeks forward, I got through to the sales office, and they said they didn't get the message from HO, they assumed I no longer was interested, and put it back on the market which has now sold!
I EVEN GOT A LETTER LAST WEEK SAYING THAT I WILL BE GET A TOUR AROUND THE NEW HOUSE!!
I am absolutely angry, I paid the reservation fee, I told them straight away that I still wanted the property and they said that's fine, they'll pass the message on.
Now, they have a few other properties which I am no so keen on.
What are my options, I want this house badly, I have found someone who has agreed to lend to me. Can I take them to court? I paid my reservation for the property, I don't want it back, I want my bloody house!!
They have a few other properties that I am not really keen on, but say if I were to take one of them, which is nearly 20k over what my house would cost. Should they atleast knock 20K of the price of the house and throw in few extras?

Whilst I feel your pain, this is exactly developer/Estate Agent mentality.
I have become more thick skinned over time, as I always expect them to do what is best "for them"
I fear you have no real recourse, the area is largely unregulated and your anger will abate over time.
Go down there on a Saturday afternoon (which is prime time) and kick up a big fuss, they are more likely to do something for you based upon nuisance antics than anything formalised.
I have seen how hard and how many applications you have made trying to pull this together, so do appreciate your frustrations...

Oh i'm so sorry FTB, that must be a a real kick in the teeth after all your hard work. Sadly all developers care about is selling their properties as quickly as possible which is why all reservation agreements have a clause that says you are committing to exchange of contracts within 28 days or they reserve the right to remarket the property. I've read other stories where this has happened and there really isn't anything you can do other than what Dave says but i seriously doubt you'll be able to get that house now. Are there other developments that are of interest to you?

Many thanks for your responses, I shall be going down there this saturday to kick up a real fuss. They have to put this right and I will make sure of it.
There are other developments that they are doing, but none that of interest to me, there have a few unsold properties on the plot but if I were to take one, they would have to drop the price by 20k to the price of property I were about to purchase on.
I am so angry and stressed. I had to give notice to my landord and I just phoned them up and they said they've got someone else to move in next month, which means I am going to be homeless as well as my unwell mother.
They will sort it out, other wise I will be going to my MP, the press and I'm sure it is not what Barratt would want.0 -
Oh so it's Barratt's is it? Funny enough that's who we're buying with. They've been fine so far but in our case luckily there weren't any major snags.0

You have rights as a tenant, house buying forum will be able to direct you more.
I do know that whoever told you to give notice before exchange of contracts needs a strong word.

How far down the legal side of things did you get? Did you even appoint a solicitor? Why did you hand in your notice on your current home when there was no certaintly of you even being able to get the required mortgage?
Surely you realise that until exchange of contracts, either the vendor or buyer can pull out of the deal without any liability to the other party?"You were only supposed to blow the bl**dy doors off!!"0 -
as far as i am aware legally, even if you have given notice on a renta, you have the right to rescind that up until the point of moving out...they shouldn't have let a tenant sign a new lease before its vacant.0

how many fantasy threads and alter ego's is enough?So today I've applied for a mortgage through barratts, they used halifax system for the credit check and it came back declined.
I checked my credit report to see that Gothia have registered a £179 default on my credit file a few days ago that shows as satisfied? I didn't pay anything because I didn't know about the debt. (Should of check my credit file before applying)
Anyway what ***** me off is that the my date of birth is 20/12/1993 yet on the credit report it started on the 09/12/2010 I was not even 18 then!!!
I am really angry about this, this has made me lose out of my dream house.
What leg do I have to stand on? I want them to pay and I damn right want compensation from them also. Now I really doubt I'll get the house with a second search.
My credit file is clean and this is the only negative on the file.
Please help.!!
