Man it really !!!!es me off when I see companies pretend stuff has to be unopened/as new when returning under the DSRs. The only obligation you have is to take "reasonable care" of the goods and companies are barred from adding anything more draconian through their T&Cs.
In any case if you sent it back as faulty and asked for a refund (and it is actually faulty, are they disputing this?) it doesn't matter if you returned it under the DSRs or acted under the SoGA; in either case the contract is treated as no longer existing so they have no basis to send you a new one. If they're demanding money for it they may even be committing an offence by sending unsolicited goods and demanding payment.
EDIT: just to say I too have been promised refunds for delivery charges by them in the past which never got processed, so I won't use them anymore. Plenty of more professional competitors in their market to shop from.0 -
I pop into their store quite frequently, as it is really handy - but i've got to say that their after sales completely sucks. The amount of customers i've seen kicking off in the store is hilarious.
It seems most complaints are with their returns policy, which to be honest is an absolute joke. I never buy expensive items from them anymore, as i dread the day that i would have to return something of value. More hassle than its worth.
The biggest pain is when they have to test the item first before they refund, and dont give the customer the benefit of the doubt.
