Devanlay E-Commerce (hereinafter the “Promoter", or the “Organiser”), a simplified joint stock company (soci!t! par actions simplifi!e) duly organized and existing under the laws of France with an issued share capital of 3 684 000 Euros, whose registered office is located at 23-25 rue de Provence in Paris (75009), France, registered au “Registre du Commerce et des Societ!s” of Paris under the number 403 285 513, is organizing a competition, free of charge without any obligation of purchase (hereinafter the "Game").

The Game, the Website and the interpretation of these terms and conditions shall be governed by the French laws and regulations. The Game can be accessed via the following websites:

ARTICLE 2. CONDITIONS OF PARTICIPATION

Registering to the Game involves the acceptance by the Participants without reserve and compliance with the provisions of these terms and conditions, available on the Site upon registration and at any moment during the Game on the Site.

2.1 Conditions of registration

The registration to the Game is open during the period indicated in Article 1 hereinabove to any person who is living in France (including Corsica), in the United Kingdom, or in Germany with the exception of the employees of the Organiser or of the companies involved in creating the Game, and of their direct family (parents, brothers and sisters, children and any other person living in the same household).

Any Participant who is under 18 years old shall obtain the prior authorization of his parents to be allowed to participate to the Game and shall accept these terms and conditions. The Organiser reserves the right to ask that the underage Participants provide proof of such authorization and, if the case may be, disqualify a Participant who is unable to provide this authorization.

In order to be eligible to take part in the Game on the Website, all Participants must complete the registration form on the Website with their title, first name, surname, and valid e-mail address. The Participants have to indicate if they accept to receive e-newsletters from the Organiser or its partners.

2.2 Participant information
In accordance with the French Data Protection Act of 6 January 1978, the Participants have a right to access, correct or delete their personal information held by the Organiser, by writing to:

Subject to their explicit consent, or where appropriate, without any opposition from the Participants, the personal data relating to Participants may be used by the Promoter and / or its partners to better serve and inform them about their new products and offers that may be of interest.

2.3 Validity of the participation

The information and contact details supplied by the Participant must be valid and genuine, under penalty of exclusion from the Game and, if applicable, loss of winning status.

It is strictly forbidden, by whatever means, to modify or attempt to modify the proposed Game devices, particularly in order to modify the results or influence, by an automated method or by any unfair means, the validity of the prize draw or the designation of a winner. If it is proved that a Participant has been drawn or has been elected to win a prize in contravention of these rules, using any fraudulent means such as automated searching or use of algorithms, or by means other than those resulting from the process detailed by the Promoter on the Website or by the these terms and conditions, the prize in question will not be awarded and shall remain the property of the Promoter, without prejudice to any legal proceedings likely to be brought against the Participant by the Promoter or by any third parties.

It is strictly forbidden for a Participant to play using several e-mail addresses or to play from a player account opened for another person. One single player account shall be opened by one person having the same first name, surname and e-mail address.

ARTICLE 3. PRINCIPLES OF THE GAME
3.1 Game Play

To register to the Game, the Participant must first indicate his/her title, name, surname and valid email address. Once registered, the Participant must find the winning pattern among six different proposed patterns, in accordance with the conditions of the article 5. The Participant will discover instantly if he/she has won or not by clicking on one of the patterns.
Then, the Participant is offered another chance to play. If he/she invites another friend to participate to the game on this page, he/she will be able to click on two different patterns instead of one.

3.2 Invitations sent by the Participant to friends or relatives

The Participant assumes the responsibility for providing the e-mail addresses of his/her relatives and friends so that such an invitation might be sent and agrees to obtain prior explicit consent and to inform the persons whose e-mail addresses he/she provides to the Promoter that the Participant has provided their e-mail addresses to the Promoter. The Promoter only acts as a technical router of messages sent in the name, on behalf of and according to the wishes of the Participant. Consequently, Participants release the Promoter from any liability related to the use of email addresses of friends or relatives sent to the Promoter and for invitation messages sent to them.

The Promoter processes traffic data related to the Game Website and retains some information, namely the IP address of the computer used by the Participant in order to establish statistics of visits to the Website, ensure the safety of the Website, and verify the fairness of participations in the Game and of their compliance with these terms and conditions. This is also to prevent or detect any automatic requests on the Game Website, or any automatic dispatch of invitation to third parties, which will systematically lead to the exclusion of the Participant concerned and prevent him/her from being eligible to win, and could expose the Participant concerned to actions being taken against him by the Promoter or by third parties.

The first eighty Participants to get three friends registered to the Game win a L.12.12 concept bag or a Fitzgerald leather wallet worth a maximum of 75€ each, all taxes included in France and Germany. In the United Kingdom, the L.12.12 concept bag is worth a maximum value of £55 all taxes included and the Fitzgerald leather wallet is worth a maximum value of £69 all taxes included.

ARTICLE 4. PRIZE DRAW

The Promoter reserves the right to replace, at any moment, any prize with a prize of a similar value or close characteristics in the eventuality of the prize being unavailable. The prize may not give rise to any dispute or claim of any kind, or be exchanged, or substituted for payment of its value in cash.

The game contains the following prizes:

4.1 If the participant is residing in France, in the United Kingdom or in Germany, and played to the game from his/her country of residence

4.2 If 3 friends invited via the game register

For the three countries altogether, the first 80 participants to get 3 friends registered win either a L.12.12 concept bag or a Fitzgerald leather wallet each worth a maximum of 75 € all taxes included in France and Germany. In the United Kingdom, the L.12.12 concept bag is worth a maximum of £55 all taxes included and the Fitzgerald leather wallet is worth a maximum of £69 all taxes included.

The prizes will be sent to the concerned participants at their place of residence in an indicative period of 10 weeks from the end of the game. Delivery delays of the prizes will not give rise to any dispute of any kind from the winner(s).

ARTICLE 5. DESIGNATION OF WINNERS

The winners will be selected (A.M) GMT using a random selection algorithm all along the game from the 29th of April 2013 until the 18th of June 2013.

An instant win produced randomly via a software generating algorithms, and is defined by the date and time each prize is made available.
As a result, the prize is allocated to the first participant who connects and selects the winning pattern once the prize is made available.

The winner will be named once their eligibility for the prize has been verified. The Participant whose name is drawn will be contacted by email by the Promoter within 15 days of the draw. If the winning Participant does not respond within 5 days of sending this email, he/she will be deemed to have renounced his/her prize.

The name and surname of the winners can be obtained by sending a stamped addressed envelope to the Promoter at the address indicated in article 2.2 above, during the month following the prize draw.

The postage costs linked to a written request for the name of the winner will be reimbursed at the current second class rate if requested.

The winner must accept that the Promoter will publish his/her name, the date he/she won and details of the prize online and offline without giving any right to compensation or benefit other than allocation of the prize.

The winner must strictly comply with these terms and conditions of the Game. In the event of non-compliance with these rules, the prize will not be awarded. Participants agree to all checks concerning their identity, age, postal address or their loyalty and genuine participation. ARTICLE 6. REIMBURSEMENT

The expenses incurred by the Participants as a result of Internet connection for registration and participation in the Game may be reimbursed upon written request addressed exclusively by post to the company 1000mercis, acting on behalf of the Promoter:

The lump sum corresponding to the reimbursement of eventual Internet connection fees incurred as a result of the registration, participation and connection to the Game in order to find out the results shall be 0.6€ or £0.6 depending on the country of residence of the Participant.

Any request must be postmarked within 15 (fifteen) days, at the latest, following the participation, and must contain the following documents and information concerning the participant:

• name, surname, mailing address and e-mail address,
• a photocopy of official ID (national identity card, passport),
• date and time of participation,
• a bank account identification slip (RIB),
• and a photocopy of detailed invoice proving Internet connection. This copy shall also serve as proof of residence.

No request for reimbursement shall be taken into account if it is sent by e-mail.

No request for reimbursement shall be taken into account unless it comes from a participant having taken part in the Game for which reimbursement of connection fees is being requested. All incomplete or illegible requests shall be disregarded.

Participants not paying connection fees directly proportionate to their connection time (those with unlimited access subscriptions: ADSL, Wi-Fi etc.) cannot request reimbursement, insofar as their connection to the site does not give rise to any specific expenses.


ARTICLE 7. LIABILITY

The content of the Website, the commercial names and brands mentioned, the graphic and computer elements and database comprising the Website, are the exclusive property of the Promoter or their respective owners and may not be extracted, reproduced or used without the written prior authorization of the Promoter or the owners, under penalty of civil and/or criminal proceedings.

Any resemblance of Game characters or elements to other fictitious characters or elements already in existence is purely coincidental and cannot engage the responsibility of the Promoter or his service provider, the company 1000mercis, acting on behalf of the Promoter.

The Promoter or the company 1000mercis, acting on behalf of the Promoter, and each of such company's employees, officers, directors, agents and representative are not responsible for and shall not incur any liability if they cancel, shorten, extend or defer the present Game or modify the terms and conditions. In all cases they reserve the option to extend the participation period. In particular, the Promoter or its service providers will bear no liability for cases where the Website is unavailable during the Game, or where the automatic draw procedure malfunctions for external reasons or where information supplied by the Participants is destroyed for external reasons.

The Promoter cannot be held responsible for the failure of any third parties to fulfil their obligations associated with this competition. The winners and their guests will be bound by any terms imposed by any third parties providing services as part of the prize. The prize may not give rise to any dispute or claim of any kind, or be exchanged, or substituted for payment of its value in cash. The winner agrees not to hold the Promoter or its service providers liable concerning the quality, specification or operation of a product or service offered as a prize within the context of the Game. By accepting a prize, the winner agrees to release the Promoter, the company 1000mercis and any other entities associated with this Game, along with each of their employees, officers, directors, agents, representatives, from any and all liability, loss or damage arising from or in connection with the awarding, receipt and/or use or misuse of prize or participation in any prize-related activity.

The Promoter reserves the right to substitute any prize which is unavailable with another prize of equivalent commercial value or of close characteristics.
