Hello friendly advisors, I am hoping you can answer a very important question for me. My partner has recently declared bankruptcy because as hard as she tried she cant clear some long standing debt from a reationship some years ago, to cut a long story short she has reached an agreement with the OR and because her outgoings are less than her income she is kind of sorted, however the OR have asked her to let them know if there are any changes in my own income as it will mean she will have to pay a proportionate ammount to them. I am right behind my partner in every way and the last thing she wanted to do was go bankrupt but the IVA didnt work out at all, is it compulsory for me to tell my wife of my income and can the OR look into my wage details and bank account without my specific permission.we dont want to end up in court obviously but we dont want to pay money we cant afford either. thanks for you time in anticipation of a usefull answer. Hi,
Any IPA can only come from your wifes spare non benefit income, not yours. It is legitimate for the IS to take in to account that you pay for an amount of household expenditure in ratio to your earnings.
If you do not disclose such information then they will assume that to contribute half towards all household bills.
In addition, infact entirely, not only must the IS consider if there is surplus according to their relatively new droconian policy, but that your partner and her family are left with sufficient funds for their reasonable domestic needs.
