Requests for CCA's - it works!!!!

Just thought I'd let everybody know that I requested a CCA from Moorcroft about 2 weeks ago regarding an old catalogue debt for £1,244, got a letter back this morning stating that they will be no longer pursing the debt, and that they will remove the default from my credit file, they even sent me my £1 cheque back!!!! Now, its probably not going to make much difference to my CR but every little helps though I'll believe that when I see it :rolleyes:

Going to keep hold of the letter - just in case ;) but its certainly worth doing - I never signed a credit agreement with the catalogue, it was all done on line so in fact they never had one but if I hadn't been made aware of this through this site I would still have to pay it so thanks.

After a very hard week, this has made my day -still a long way to go with our debts buts its a start :T . Thats now 3 debts gone now - 2 paid off and 1 written off and am going to try this with the other catalogue debts, can't see any reason why not to as they are all with Moorcroft :confused:

    Consumer Credit Agreement - something you sign in order to take out credit services. HTH

    Well done chick. I am so pleased for you. Told you that the dcas buy debts for next to nothing. Its always worth a try. Please remember the debt could be picked up by another DCA. But just send the same letter off to them. I am not saying dont pay your debts. But at least when you can pay a little bit off you are paying the right people.

    Keep a check on your credit file. And make sure the default gets removed. It can take up to six weeks. As they do not update regularly.

    Oh yes indeed it does. But really only if it has gone to a DCA. If you write to the actual creditor then they may well come up with The CCA. A lot of DCAs send you what most people think is the agreement. Its not . They usually send a copy of your application form. This is not the consumer credit agreement. So be wary of what they try and send you.

    Please anybody - don't get me wrong - we fully intend to pay our debts, we spent the money, we'll pay it back etc but the fact remains that DCA's are a law onto themselves, they hounded and hounded us even when Andy was in hospital and we had such little income and they made things seem 100 times worse and also, yes, we did spend the money but some of the companies "lent" us money without evening knowing our circumstances or checking our income, things like that and they continued to increase credit limits etc and in that way, I think they were not being responsible lenders as such. Now, I'm not in anyway saying we were responsible for borrowing the money (or buying things from catalogues), we weren't but did what we needed to do in order to live. The debts from before Andy was ill were all taken out in good faith with us intending to pay back what we owed, unfortunatly circumstances prevented us from doing so and thats when we got into trouble - with nobody giving a t*ss, just giving us more credit even when informed of our situation.

    Its not so much as not wanting to pay the debts back - well, to be honest who would if they didn't have to, its just the fact that in this case we fought back against the bullies that hound us. Just feel like we needed to stand up to them.

    Just didn't want anybody reading this to get the idea that you can clear all your debts by doing this - you may clear some, you may not but just make sure you know what you are doing and that it may not end up that your debt is cleared - creditors may well produce a valid CCA - its just something to look at :confused:

    By not paying this debt at the moment (hopefully never :rolleyes: ) it means we can pay more towards another debt, not have more money in our pockets.
